News  Massachusetts Board of Medicine Takes Disciplinary Action

WakefieldAt its meeting on April 18, 2019, the Massachusetts Board of Registration in Medicine took disciplinary action against the medical licenses of William Ortiz, M.D.,Sujan Kayastha, M.D., and Francisco Gutierrez, M.D.

In a Final Decision & Order, the Board revoked Dr. William Ortiz’s right to renew his license to practice medicine after the Board found that Dr. Ortiz surrendered his license to practice medicine in Maine after agreeing that he fraudulently procured his medical license and did not disclose he was subject to pending allegations in another state.  Dr. Ortiz was licensed to practice medicine in Massachusetts from April 14, 1999 until he failed to renew his license on February 16, 2018.   He last practiced medicine in Maine in 2018.

In a Consent Order, the Board indefinitely suspended the medical license of Dr. Francisco Gutierrez after he agreed that he had engaged in conduct that undermines the public confidence in the integrity of the medical profession, including inappropriately touching, kissing and hugging staff members at his place of employment. The Board immediately stayed the suspension upon his entry into a probation Agreement. Dr. Gutierrez has been licensed to practice medicine in Massachusetts since 2013.

The Board summarily suspended the medical license of Dr. Sujan Kayastha after finding that he poses a serious and immediate threat to the public health, safety and welfare when he was arrested and arraigned on two counts of dissemination of obscene matter to a minor, two counts of enticing a child under the age of eighteen through electronic communication to engage in prostitution, one count of trafficking of a person for sexual servitude and a single count of possession of child pornography. Dr. Kayastha has been licensed to practice medicine in Massachusetts since 2012 and last practiced in New Bedford.

The Massachusetts Board of Registration in Medicine licenses more than 40,000 physicians, osteopaths and acupuncturists.  The Board was created in 1894 to protect the public health and safety by setting standards for the practice of medicine and ensuring that doctors who practice in the Commonwealth are appropriately qualified and competent.
