Press Release  Prosecutors Terminate Case Against Salem Man in Fatal Pedestrian Incident

Salem, Massachusetts — The Essex District Attorney's Office has terminated the case against Francisco Garcia, 25, of Salem, who was charged with Accessory After the Fact to Leaving the Scene After Death.   A Nolle Prosequi, which withdraws the prosecution of the case, was filed yesterday afternoon in Salem District Court.

After a thorough review of all of the evidence in the case by the Salem Police Department and the Essex District Attorney’s Office, a determination was made that the evidence will not permit the Commonwealth to meet its burden of proof beyond a reasonable doubt at trial.

The fatality of the pedestrian, Phillip Grieves, 42, remains under investigation.
