News  Public Notice Regarding Changes in Adult Guardianship and Conservatorship Forms

The Probate and Family Court today announces changes to the following adult guardianship and conservatorship forms. The revised forms shall be required for filing on or after September 3, 2019, including in cases initiated before September 3, 2019. The revised forms will be available on August 30, 2019 on the Probate and Family Court website at: https://www.mass.gov/lists/probate-family-court-forms-for-guardianship-and-conservatorship. A grace period of September 20, 2019 shall be granted to accept for filing any pre September 3, 2019 forms.

 Incorporated form MPC 720A, Exhibit A Limitations to Guardianship, into the last page of this decree.
MPC 720A Exhibit A Limitations to Guardianship Deleted 9/3/2019  Form MPC 720A is deleted as the contents have been incorporated into the last page of form MPC 720, Decree and Order of Appointment of Guardian for an Incapacitated Person.
MPC 821 Guardian’s Care Plan/Report Revised 9/3/2019

 Replaced fillable boxes (blank space) with lines throughout the form;
 Added “Date of Decree of Guardianship” below Instructions section;
 In #1b: Added checkboxes for level of care and deleted #7 on level of care;
 In #2: Deleted yes/no question re: level of care;
 In #3: Deleted reference to Rogers Monitor Supplemental Report;
 In #8: Re-worded;
 Added email address line to Certificate of Service for Guardian;
 Incorporated most of the contents of form MPC 621, Notice and Order on Guardian Care Plan Report, into the last page of the Report.

MPC 821A Checklist for Reviewing Guardian’s Care Plan Report for Incapacitated Persons Revised 9/3/2019  Corrected spelling errors; minor format changes.
MPC 824 Roger’s Monitor Supplemental Report to the Guardian’s Care Plan/Report Deleted 9/3/2019  Form MPC 824 is deleted and replaced with form MPC 821, Guardian’s Care Plan/Report and form MPC 404, Report of Monitor.
MPC 823 Clinician’s Affidavit and Report for Extension and/or Amendment of Treatment Plan Revised 9/3/2019  Deleted “Substituted Judgment” from title of the form;
 Added “Incapacitated Person” to caption;
 Revised clinician’s signature page to be consistent with the clinician’s signature page found in the medical certificate form requiring clinician’s license #, etc.
MPC 827 Review Order Antipsychotic Medication Revised 9/3/2019  Replaced “respondent” with “incapacitated person” throughout form;
 Numbered the form and deleted checkboxes where necessary;
 In #1: Revised to refer to Clinician’s Affidavit and Report and added exam date;
 In #3: Added name of Monitor and that the monitor shall continue to monitor the treatment plan; replaced “physician” with “clinician” in C – F;
 In #5: Added “Other” as an option for additional orders.
