Press Release  Two men convicted for 2020 murder in Lynn

SALEM — Two men were convicted Tuesday of first-degree murder for the 2020 killing of a Lynn man who was shot in what prosecutors said was an unjustified attack by two gang members, Essex County District Attorney Paul F. Tucker announced.

Tyrell Junior Berberena, 27, of Malden and Marcus Carlisle, 25, of Lynn were among four men originally arrested in the case.

Berberena and Carlisle each were convicted of all 13 counts for which they were tried, including four counts each of armed assault with intent to murder, assault and battery by means of a firearm and assault and battery with a dangerous weapon causing serious bodily harm.

The third man arrested, Josue Cespedes of Lynn, pleaded guilty to manslaughter last year and received a sentence of 9-12 years. The fourth, Elijah Fontes-Wilson, also of Lynn, will plead guilty in the future to accessory before the fact to assault and battery by means of a dangerous weapon. He testified at the trial of Berberena and Carlisle under a plea agreement.

Each was arrested following the murder of Noe Hernandez, 35, of Lynn, on July 4, 2020. Four others also were shot when the defendants allegedly fired 20 rounds into a cookout as they drove past in a rented pickup truck.

“I appreciate the jury’s patience while hearing a long and complicated case,” said Tucker. “The truth prevailed and I hope it brings some relief to Noe’s family and those injured in this intentional and unjustified attack. I also want to thank Lynn Police and the State Police Detective Unit assigned to the Essex County District Attorney’s Office for their expert work in locating witnesses, making arrests and seeing this case through by testifying during this trial.”

Testimony began Feb. 21 and the case went to the jury in Salem Superior Court on Monday.

Tucker praised the work of Assistant District Attorneys Susan Dolhun and Stefanie Stanbro, the lead trial attorneys, as well as Assistant District Attorneys Kathryn Janssen and Jay Gubitose and Victim Witness Advocate Maria Arroyo-Long.

Superior Court Judge Salim R. Tabit presided over the case.
