Section 7 prohibits a state employee from leasing space to a state agency since such action would constitute a direct financial interest in a contract made by a state agency.
You are employed full-time by a state agency. You ask whether you may purchase a building and rent space to the agency without violating the Commonwealth's conflict of interest statute, General Laws Chapter 268A.
You are a state employee as that term is defined in General Laws Chapter 268A § 1(q). Section 7 prohibits a state employee from having a direct or indirect financial interest in a contract made by a state agency. The Attorney General has ruled in a similar case that your proposed course of action would come within the prohibitions of § 7. See Attorney General Conflict Opinion No. 33 and 749. We adhere to the Attorney General's Opinion.
