Disclosure Requirements For Fees And Charges
On August 31, 1997, the Division promulgated amendments to regulations entitled Establishment And Operation Of Electronic Branches Of Financial Institutions And For The Protection Of Consumers In Electronic Funds Transfers at 209 CMR 31.00. Pursuant to 209 CMR 31.07(1), financial institutions annually must file, by January 31, a complete written schedule of all fees and charges assessed to consumers who use their ATMs. 209 CMR 31.07(2) requires that any amendment to such schedule must state the effective date of the amendment and must be filed, in writing, with the Division at least 30 days prior to such date.
