Probate and Family Court Rules  Probate and Family Court Standing Order 3-16: Remote access to electronic court records for Probate and Family records

Rule 5 (a) (iii) of the Trial Court Rule XIV, Uniform Rules on Public Access to Court Records, provides that each Department of the Trial Court, subject to the approval of the Chief Justice of the Trial Court after notification to the SJC, may exempt certain civil case types or categories of information from remote access.  

Probate and Family Court Estate Administration electronic case information is currently available remotely.  Effective November 1, 2016 electronic case information for Equity cases will be available remotely, with the exception of Paternity cases filed in equity pursuant to G. L. c.215, §6.

The following exemptions have been approved for these case types and types of information of the Probate and Family Court:

For all Divorce, Paternity, Guardianship, Conservatorship, Trust, Separate Support, Modification, Contempt, and Change of Name case types not restricted or impounded by other standing orders, rules or orders of the court, the following information shall be available through remote public access:

• Case Name
• Party Names
• Attorney Information
• Event Dates
• Subsequent Actions
• Case Disposition

For all Divorce, Paternity, Guardianship, Conservatorship, Trust, Separate Support, Modification, Contempt, and Change of Name case types not restricted or impounded by other standing orders, rules or orders of the court, the following information shall NOT be available through remote public access:

• Addresses for parties, whether represented by counsel or not
• Docket entries
