MassDEP has been working on drafting guidance related to Active Exposure Pathway Mitigation Measure (AEPMM) Operating Regimens. An AEPMM Operating Regimen is required under 310 CMR 40.1025(3) and 40.1026(3) for AEPMMs operating under a Permanent Solution, Temporary Solution or Remedy Operation Status. The operating regimen must be designed to ensure a level of No Significant Risk is maintained for the Receptor(s) of concern under normal operating conditions. Based on inspections and evaluations of these systems, the Department has determined that steps are needed to better document the efficacy of these systems, comply with MCP performance standards and regulatory requirements, and ensure protection of public health.
To further this effort, MassDEP has decided to host a virtual information gathering session to hear from the public on what elements should be included in the Operating Regimen to ensure a level of No Significant Risk. The information gathered will be considered in developing the AEPMM Operating Regimen guidance document.
The virtual meeting will take place during the scheduled MassDEP BWSC Office Hours on March 19, 2026 from 9 am to 11 am.
