A member of the General Court may continue to serve on the Board of Directors of two non-profit corporations and on an agency area board, and may appear personally before state agencies on their behalf, since he is not compensated for his services. Furthermore, his membership on these boards will not require him to disqualify himself in "particular matter(s)" relating to them since the "enactment of general legislation" is specifically excluded from the definition of "particular matter".

A member of the general court may participate in general legislation which would affect a case in which his law partnership is involved because general legislation is excluded from the definition of "particular matter". If this were a situation in which he was required to act as a legislator, he would have to file a disclosure as required by section 6A. However, he may not participate as a legislator in special legislation because it would affect his financial interest by potentially controlling the court case. He must file a disclosure if such special legislation comes before him and he is required to act on it.

  • EC-COI-82-2

  • EC-COI-82-176

May a state employee perform classroom instruction for a driver education course while simultaneously employed by the RMV?

  • EC-COI-89-8

A member of the General Court must abstain from sponsoring, advocating or voting on special legislation in which his immediate family member has a foreseeable financial interest.
