The Massachusetts Department of Transportation (MassDOT) offers businesses, utilities, and other organizations the opportunity to apply for the Use & Occupancy of Rail Property.

This program enables access to MassDOT-owned rail property for a variety of uses such as utility installations, environmental assessments, and construction projects.

Types of Use & Occupancy Agreements

MassDOT offers several types of agreements depending on your proposed use:

  • Right of Entry (ROE): Short-term access for tasks such as site inspections, surveys, or environmental assessments.
  • License Agreements: For long-term, non-structural use of property, such as utility installations.
  • Lease Agreements: Allows limited interest in land or property (such as buildings) for a designated period.
  • Easements: Grants permission to use land for specific purposes like utility installations or private crossings.
