The Commission dismissed the appeal of a Bridgewater police sergeant who was bypassed for promotion to lieutenant in 2023 as untimely and moot after the Commission, in another matter, declined to vacate the original promotion.

Based on applicable law, the Commission opted to deny a petition for the award of $25,000 in additional attorney's fees but confirmed that the bypassed candidate who prevailed in her appeal before the Commission is entitled to be reimbursed by the Bridgewater Police Department for $2,075 in fees.

The Commission granted the Motion for Reconsideration filed by the Town of Fairhaven to incorporate into the Commission’s prior Decision the parties’ agreed form of retrospective and prospective relief designed to rectify the Town’s failure to comply with civil service law in making appointments and promotions.

The Commission affirmed the decision of the Boston Police Department to bypass a candidate for appointment as a police officer based on her history of poor judgment and her failure to be forthcoming about her association with known criminals.

The Commission dismissed the Appellant’s appeal as the Commission lacks jurisdiction regarding the appointment of Correction Officers at the Middlesex Sheriff’s Office.

The Commission allowed the Appellant’s bypass appeal for original appointment as a Boston police officer as the Boston Police Department failed to establish by a preponderance of the evidence that judgment and conduct issues prevented the Appellant from meeting the high standards required of police officers.

The Commission allowed the appeal of a candidate bypassed for appointment for police officer based on his driving history and prior employment history as the Boston PD was either unable to support the reasons for bypass or show a connection between the reasons and the candidate's current ability to serve.

The Commission affirmed the decision by the Boston Police Department to bypass a candidate for police officer due to concerns about the candidate’s judgment and conduct related to a 2016 domestic violence incident.
