Matter addressed violations of state's sanitation rules necessary to safeguard public heath and permitting and reporting requirements. This included: (1) harvest, possession, and sale of shellfish from a contaminated shellfish growing area closed to shellfish harvest; (2) possession and sale of shellfish without a complete and accurate shellfish harvester tag affixed to each container of shellfish; (3) possession and sale of shellfish with possessing a Commercial Shellfish Permit or Transaction Card; (4) failure to display a commercial fishing permit; and (5) violations of permit conditions. Final Agency Action resulted in the permanent revocation of Fountain's Commercial Shellfish Permit and Transaction Card.
