Decision  Joseph D. Brooks v. Hoboken Floors

Date: 06/23/2009
Organization: Department of Industrial Accidents
Docket Number: DIA Board No. 003089-07
Location: Boston
  • Employee: Joseph D. Brooks
  • Employer: Hoboken Floors
  • Insurer: Crum & Forster Indemnity Co.

KOZIOL, J. The insurer appeals from an administrative judge's decision ordering it to pay the employee § 34 total incapacity benefits from January 16, 2007 to date and continuing, as a result of post traumatic brachial plexopathy affecting the right C5 and C6 nerve root. (Dec. 8-9.) The insurer argues that recommittal is required because the judge failed to make any findings of fact showing that she performed the analysis required by § 1(7A). Vieira v. D'Agostino Assocs., 19 Mass. Workers' Comp. Rep. 50, 52-53 (2005). We affirm the decision.
