Decision  Leonard Howze, Jr. v. MBTA

Date: 05/19/2011
Organization: Department of Industrial Accidents
Docket Number: DIA Board No. 2482407
Location: Boston
  • Employee: Leonard Howze, Jr.
  • Employer: MBTA
  • Self Insurer: MBTA

FABRICANT, J. The self-insurer appeals from an administrative judge's decision finding it liable for injuries the employee, a bus driver, suffered on a public street while trying to switch from a bus on which he was a passenger, to a bus he was scheduled to drive. The self-insurer maintains the judge's conclusion that the employee's injuries arose "in the course of his employment,"1  is unsupported by the evidence and contrary to law. We disagree and affirm the decision.
