  1. What to Know

    • A separate notification needs to be filed for each asbestos abatement job performed in Massachusetts.
    • MassDEP will accept a notification filed by the property owner or operator, licensed asbestos abatement contractor, or other entity performing the asbestos abatement. DLS requires that the notification be filed by the licensed asbestos abatement contractor.
    • You'll need to provide DLS License and Certification numbers in each notification. Most asbestos contractors will give these numbers to you.
    • It is important to identify the date on which you plan to start asbestos removal work. Your waiting period of ten (10) working days starts once you submit your notification.

    eDEP Online Filing

    If you are a new user, you will need to create an account first. Registration takes less than five minutes.

    When submitting a notification via eDEP, you will pay the fee online using a credit card. “Fee decals” are no longer sold and may not be used to file online.

    eDEP will automatically upload your notification to the MassDEP Asbestos Project Lookup database, which is refreshed every 15 minutes. Use this tool to confirm your submission.

  4. Wait Ten (10) Working Days

    Once you submit your notification, MassDEP and DLS will have ten (10) working days to review it.

    You may proceed with your project if neither agency contacts you before this waiting period is over.

    If MassDEP and/or DLS finds your notification deficient, the agency will order you not to proceed with work and give you 30 calendar days to respond.

    After you submit a corrected or revised notification, MassDEP and DLS will have ten (10) working days to:

    • Accept your notification and allow you to proceed with work, or
    • Issue you a "stop" order.

    Should one or both of the agencies not allow you to proceed, you will need to submit a new notification and fee payment for work to be done at the same location.

  5. Start Work or Revise Your Notification

    You may begin asbestos removal work only after the waiting period of ten (10) working days specified by the MassDEP asbestos regulation (310 CMR 7.15) has elapsed. Starting early is a violation and may result in enforcement action, including financial penalties.

    If you are unable to wait ten (10) working days before starting work, you must obtain an emergency waiver of the notification requirement. Contact MassDEP for additional information.

    You must begin work on and complete work by the “start” and "end" dates indicated in your notification. If you plan to change either or both of these dates, you MUST file a notification revision via the eDEP. See the instructions for details. There is a $35 fee for each revision. No revisions may be made after the "end" date in your original notification.
