What you need for WPA Form 5: Order of Conditions
This form is for use by Conservation Commissions when issuing an Order of Conditions to an applicant under the Wetlands Protection Act.
How to file WPA Form 5: Order of Conditions
NOTE: The eDEP version of the Order of Conditions does not reflect revisions made to the Order of Conditions in April 2015 to include riverfront-area impact for coastal resource areas. Use the downloadable form if the project includes these elements.
Orders of Condition may be mailed or hand-delivered to the applicant. See instructions in Step 2, below.

Complete the Order of Conditions
If you cannot use eDEP, you may fill out and save the Microsoft Word form on your computer. The PDF version has to be printed out and completed by hand.
The signatures-only page is for Conservation Commission use to record the issuance of an Order of Conditions.

Mail by Certified Mail (return receipt requested) or hand-deliver the Order of Conditions to the applicant. A copy must also be mailed or hand-delivered at the same time to the appropriate MassDEP Regional Office, and the property owner, if different from the applicant.
Appeals of the Order of Conditions
The applicant, the owner, any person aggrieved by the Order, any owner of land abutting the land subject to the Order, or any 10 residents of the city or town in which such land is located, have the right to request the appropriate MassDEP Regional Office to issue a Superseding Order of Conditions.
Such a request must be made by certified mail or hand delivery to the Department, with the appropriate filing fee and a completed Request for Departmental Action Fee Transmittal Form, within 10 business days from the date of issuance of the Order. A copy of the request shall at the same time be sent by certified mail or hand delivery to the Conservation Commission and to the applicant, if he/she is not the appellant.
