On November 22, 2024, MassDEP finalized amendments to the Greenhouse Gas Emissions Reporting regulation (310 CMR 7.71). Demonstration of Non-Applicability
Pursuant to 310 CMR 7.71(3)(d), if your company does not sell heating fuel in Massachusetts and you have received communication from MassDEP regarding registration in CHETS, the Department has determined that you may be subject to the requirements of 310 CMR 7.71. If you do not sell heating fuel in Massachusetts you must certify and submit a Demonstration of Non-Applicability for Heating Fuel Suppliers to the Department to dep.chets@mass.gov. A fillable PDF of the Demonstration of Non-Applicability for Heating Fuel Suppliers can be found below.

Reporting
Heating fuel suppliers are required to report emissions data quarterly. The first reporting deadline has been deferred from April 30, 2025 to June 2, 2025. MassDEP has provided several resources to help heating fuel suppliers prepare for reporting, including detailed instructions and a spreadsheet tool to assist in determining total fuel volumes delivered each quarter based on delivery ticket records. This tool will be most helpful to heating fuel suppliers that deliver different biofuel blends over the course of a calendar quarter. Descriptions of the different categories of fuel are available in the FAQ, linked at the top of this page.

Heating Fuel Storage Facilities
Background
As of January 2025, Heating Fuel Storage Facilities were required to begin reporting monthly fuel shipment data.
MassDEP is transitioning from emailed report submissions to online submissions via the Fuel Shipment Tracking System (FSTS). Heating Fuel Storage Facilities are required to register in the FSTS by Friday, May 29, and begin reporting using the FSTS by Tuesday, June 30.
Registration
Designated Representatives for Heating Fuel Storage Facilities must first register as users with the FSTS, then register their facilities.
Optionally, Designated Representatives may assign additional users (“designees”) to their facilities, allowing designees to submit reports on behalf of the Designated Representative.
Step-by-step registration instructions can be found below.
