Model Bylaws
DOER developed Model Bylaws for Solar Photovoltaic Systems and Battery Energy Storage Systems (BESS) to serve as a resource to municipalities to regulate Solar and BESS Facilities. These Model Bylaws are designed to align with 225 CMR 29.00: Small Clean Energy Infrastructure Facility Siting And Permitting Draft Regulation, and accompanying DOER Guidelines, however, be advised that neither the Solar Photovoltaic Systems or BESS Model Bylaw are offered under the regulatory umbrella of 225 CMR 29.00, nor are they related to the 2024 Climate Act.
Stakeholder Input and Process
To develop these bylaws, DOER worked with a wide range of stakeholders.
- We began by holding stakeholder interviews and workgroups to gather feedback and identify key issues.
- Using that input, we drafted straw proposals for the model bylaws and conducted in-person and virtual listening sessions.
- Public comments were accepted from October 6 – November 14, 2025.
DOER acknowledges that these models represent our own understanding of state law and has made every effort to carefully research this issue. While DOER believes our interpretation is reasonable, we anticipate that local municipal counsel may offer a different interpretation and that communities will need to consider these alternatives moving forward. It is highly recommended that any local regulatory language developed from these models be reviewed by municipal counsel prior to adoption.
