Licensing requirement for out-of-state debt collector

A Texas corporation services charge-off portfolios for national lenders and also collects on portfolios it has purchased. The corporation does not anticipate operating an office in Massachusetts and does not anticipate having any employees reside in Massachusetts. All services are performed in San Antonio. The Division has concluded that the services provided included the collection of debt.

It is the Division's position, that the Texas corporation is required to be licensed as a collection agency under the provisions of section 24 of chapter 93 of the Mass. Gen. Laws in order to collect payment that are more than 30 days past due on behalf of other entities.
