Licensing requirements for entities collecting debt owned by deceased persons

It is the opinion of the Division of Banks that Mass. Gen. Laws chapter 93 § 24 does not allow entities which collect debt from deceased debtors to be exempt from the collection agency licensing requirements. Therefore, such entities must obtain a collection agency license and comply with the provisions of Mass. Gen. Laws chapter 93 § 24, as well as 209 CMR 18.00 et seq.
