Policy relating to multi-employer apprentice plans

The laws governing apprenticeship currently allow the Director to institute proceedings to suspend sponsors only. In the case of a multi-employer apprentice plan ("Plan"), the Director recognizes that the suspension of the sponsor of a Plan could work a significant hardship on apprentices who participate in a Plan as well as innocent employers who draw apprentices from the Plan. Therefore, the Director adopts the following policy:

When a violation of the apprenticeship laws is alleged, the apprentice program sponsor and any relevant employer shall be notified in writing of the proposed suspension and the reasons therefore. If a violation is found, and as a result a suspension is imposed, the sponsor may opt to make a showing that the offending employer will be prohibited from drawing apprentices from the Plan for the duration of the suspension. If the Director is satisfied by the showing made by the sponsor, the sponsor will not be suspended.
