Procedures For Service of Process

Upon receipt of legal process, it is the obligation of the Commissioner to forward a duplicate copy to the foreign insurance company at the home office address on record with the Division.

Procedures For Service Of Process

To properly serve the Commissioner of Insurance with process, please use one of the following methods:

Method 1

A Constable or Sheriff should serve two copies of legal process upon the Commissioner in hand. A processing fee in the amount of $6.00 is required to be submitted with the material. Please make your check (cash is not accepted) payable to the Commonwealth of Massachusetts.

Method 2

The Commissioner of Insurance will also accept service of process by Certified Mail. If you choose this method, please provide us with an original summons and 2 copies of both the summons and complaint along with a check in the amount of $6.00 (per company). Checks should be made payable to the Commonwealth of Massachusetts. (The original summons will be returned to you as Proof of Service.)

The Division is not authorized to accept service of process for a domestic insurance company. In this case, service of process must be sent to the company itself or in accordance with other available legal procedures.
