What you need   for File a Municipal Light Plant Tariff with the DPU

  1. A copy of the new tariff.
  2. A cover letter that includes the following information:
  • Tariff number (i.e., "M.D.P.U. No.")
    • The DPU maintains a tariff log and must ensure that all tariff numbering complies with DPU requirements, such as not duplicating tariff numbers that have been previously used.  Therefore, prior to filing a new tariff with the DPU, the municipal light plant should email Lynn Holzer in the Rates and Revenue Requirements Division (Lynn.Holzer@mass.gov) to confirm the proposed tariff number. 
  • Number of tariff (if any) being replaced by new tariff (i.e., "Cancelling M.D.P.U. No.")
  • Effective date of the new tariff​​

How to file   File a Municipal Light Plant Tariff with the DPU

Email a copy of the most recent tariff to:

  1. Lynn.Holzer@mass.gov and
  2. Emily.Luksha@mass.gov 

The subject of the email and the attachment should be labeled as: "(Town Name) M.D.P.U. No XXX - MM.DD.YY" where MM.DD.YY is the effective date of the new tariff.

Pursuant to G.L. c. 164 § 58, each municipal light plant engaged in the manufacture and sale or distribution of electricity and/or gas in Massachusetts must maintain fixed schedules of prices for gas and electricity (also known as "tariffs").  Such prices shall not be changed more often than once in three months.   Any change shall take effect on the first day of a month and shall first be advertised in a newspaper, if any, published in the municipality. 

In addition, pursuant to G.L. c. 164,  § 59, when a municipal light plant fixes or changes a price for gas or electricity, it must file a new tariff with the DPU within sixty days.
