October 1st, 2024 | Board Meeting SouthCoast Wind Energy Brayton Point EFSB 22-04 1PM-5PM | The Massachusetts Energy Facilities Siting Board will conduct a public meeting at 1:00 p.m. on Tuesday, October 1, 2024, to consider the Tentative Decision in the above-referenced matter. Pursuant to Massachusetts Open Meeting Law, G.L. c. 30A, §§18-25; 980 CMR 2.04(1), the Siting Board will conduct a hybrid in-person/remote Siting Board meeting to hear comments, deliberate, and vote on the Tentative Decision on Tuesday, October 1, 2024, at 1:00 p.m. at 1 South Station, Department of Public Utilities, 3rd Floor Large Hearing Room, Boston, Massachusetts. The purpose of the Siting Board meeting is to listen to comments, deliberate, and vote on whether to approve, approve with conditions or amendments, or reject a Tentative Decision issued by the Siting Board. The Tentative Decision is also now available on the Siting Board’s information webpage for this proceeding. September 3-30, 2024 | Notice of MA Energy Facilities Siting Board Proposed Action by Consent Park City Wind EFSB 20-01 9AM-5PM | NOTICE The Massachusetts Energy Facilities Siting Board (“Siting Board”) hereby provides notice of a proposed Action by Consent. The Action by Consent corrects an omission in Condition S of the Siting Board’s Final Decision in Park City Wind LLC, EFSB 20-01/D.P.U. 20-56/20-57 (December 15, 2023) (“Final Decision”). Condition S requires Park City Wind LLC to provide certain compliance filings that “demonstrat[e] that the Onshore Substation’s actual noise profile is consistent with the modeled results it has presenting in this proceeding.” Final Decision at 154. Condition S in the Final Decision references equipment in Exhibit VW-7, at 7-12, Table 7-3. The Siting Board intended for Condition S to apply to all noise producing equipment at the proposed Substation, including additional equipment listed in Exhibit VW-7, at 7-13, Table 7-4. This Action by Consent corrects that omission, and adds reference to equipment at Exhibit VW-7, at 7-13, Table 7-4 to Condition S. The Action by Consent is taken pursuant to 980 CMR 2.07, which provides the Siting Board with the authority to render a decision, other than a final decision in an adjudicatory proceeding, by Action by Consent, when the Board determines that expeditious action is necessary. June 18 - July 8, 2024 | Notice of MA Energy Facilities Siting Board Proposed Action by Consent | The Massachusetts Energy Facilities Siting Board (“Siting Board”) hereby provides notice of a proposed Action by Consent. The Action by Consent delegates to the Secretary of the Executive Office of Energy and Environmental Affairs (the “Secretary”) authority to sign on behalf of the Siting Board an engagement letter (“Engagement Letter”) with Mintz, Levin, Cohn, Ferris, Glovsky and Popeo, P.C. (“Mintz”), relating to Superior Court litigation in Commonwealth of Massachusetts v. Exxon Mobil Corporation, Civil Action No. 1984-CV-03333-BLS1 (“Litigation”). The Attorney General for the Commonwealth of Massachusetts initiated the Litigation on October 24, 2019, alleging multiple violations of G.L. c. 93A by Exxon Mobil Corporation. On April 30, 2024, Exxon Mobil Corporation served the Siting Board a subpoena duces tecum (“Subpoena”). The Subpoena relates to Superior Court litigation in Commonwealth of Massachusetts v. Exxon Mobil Corporation, Civil Action No. 1984-CV-03333-BLS1. The Siting Board is not a party to the litigation. In the Engagement Letter, Mintz agrees to represent the Siting Board in the Litigation, involving third-party subpoenas filed by Exxon Mobil Corporation. The Action by Consent is taken pursuant to 980 CMR 2.07, which provides the Siting Board with the authority to render a decision, other than a final decision in an adjudicatory proceeding, by Action by Consent, when the Board determines that expeditious action is necessary. The Siting Board may delegate Board-specific responsibilities other than responsibility for the final decision in any matter to the Board Chairman or to the Board staff. 980 CMR 2.05. The Siting Board makes the delegation to the Secretary by Action by Consent rather than by meeting. The Action by Consent requires the unanimous written consent of all members of the Siting Board to become effective.
