Competitive suppliers, electricity brokers, and gas retail agents must record outgoing calls to residential consumers conducted on their behalf for which the duration exceeds 1 minute.

Competitive suppliers, electricity brokers, and gas retail agents must record outgoing telemarketing calls to residential consumers conducted on their behalf (i.e. calls not initiated by a consumer).  Entities must keep all calls for which the duration exceeds 1 minute.  It does not matter if the call did or did not result in an enrollment.  Entities must keep the recordings for a minimum of 2 years.  The 2-year period starts from the date of the telemarketing call. 

The DPU must have access to such recordings in a timely manner.  The DPU will discuss with stakeholders the means by which the DPU will access such recordings.
