Recording of telemarketing calls

Competitive suppliers, electricity brokers, and gas retail agents must record outgoing calls to residential consumers conducted on their behalf for which the duration exceeds 1 minute.

Recordings

As of August 3, 2020, competitive suppliers, electricity brokers, and gas retail agents must record outgoing telemarketing calls to residential consumers conducted on their behalf (i.e. calls not initiated by a consumer).  Entities must keep all calls for which the duration exceeds 1 minute.  It does not matter if the call did or did not result in an enrollment.  Entities must keep the recordings for a minimum of 2 years.  The 2-year period starts from the date of the telemarketing call. 

The DPU must have access to such recordings in a timely manner.  The DPU will discuss with stakeholders the means by which the DPU will access such recordings.
