The Details   of Request a BSEA Hearing

What you need   for Request a BSEA Hearing

A hearing request may be filed with the BSEA by any of the following people:

  1. The student (if age 18 or over);
  2. The parent(s), or foster parent(s);
  3. Legal guardian;
  4. An individual with court-appointed educational decision-making authority;
  5. An individual acting in the place of the parent (including a grandparent, stepparent or other relative) with whom the student lives, or an individual who is legally responsible for the student’s welfare;
  6. A surrogate parent appointed by the Educational Surrogate Parent Program;
  7. Special education director of the responsible school district or state education agency; or
  8. An attorney or advocate representing any of these people.

A hearing request must include the following information:

  1. Name and address of the student;
  2. Name of the school the student attends;
  3. Name, address and telephone number of both parents or legal guardian, if known;
  4. Name of responsible school district or state agency;
  5. Name, address, telephone number and fax number of the attorney or advocate (if any) representing the party filing the hearing request;
  6. Statement of the issue(s) to be resolved through the BSEA appeals process, including the facts relating to the issue(s);
  7. Statement explaining the resolution sought through this process.

How to request   Request a BSEA Hearing

A due process hearing may only be requested by filing a written request with the opposing party(ies) and simultaneously with the BSEA, at 14 Summer Street, 4th Floor, Malden, MA 02148.

A BSEA Hearing Form may (but is not required to) be used for this purpose.

A due process hearing may only be requested by filing a written request with the opposing party(ies) and simultaneously with the BSEA, by fax at (781) 397-4770.

A BSEA Hearing Form may (but is not required to) be used for this purpose.

A due process hearing may be filed in person at the BSEA, at 14 Summer Street, 4th Floor, Malden, MA 02148.

 A written request with the opposing party(ies) also needs to be filed simultaneously.

A BSEA Hearing Form may (but is not required to) be used for this purpose.
