MUPC Article V procedural outline - H. Independent medical exams

The contents of this outline are intended to provide general guidance to Court staff in the handling of guardianship of incapacitated persons and conservatorship cases. This outline does not cover guardianship of minors matters.

1. Generally under guardianship actions only, an independent medical exam can be requested by Counsel with the filing of a motion for funds pursuant to G.L. c.261, §§ 27AG.
2. Do not require notice be given to any other party prior to request being presented to the Court.
3. The funds requested may be limited by the Court.
