The Registry of Motor Vehicles (“RMV”) has a new certification requirement related to the disclosure of RMV records under Section 7 of Chapter 81 of the Acts of 2022, An Act relative to work and family mobility, commonly known as “WFMA.” This new law, effective July 1, 2023, removed the lawful presence requirement for individuals applying for a Massachusetts Standard Driver’s License (Class D or M) and creates an identity and date of birth standard in its place. Language within WFMA expressly prohibits the RMV from disclosing records related to an applicant for a Massachusetts permit or related to the holder of a Massachusetts Driver’s License, except as required by federal law or as allowed under regulations promulgated by the Massachusetts Attorney General’s Office (“AGO”).

eServices

The eServices Portal (ATLAS) stores personal and confidential data. The Federal Driver Privacy Protection Act and the MA Identity Theft Act, M.G.L. Chapter 93H protects this information. All transactions are the official records of the RMV; they are recorded, stored, monitored, and audited. The RMV may, in its discretion, require you to explain and/or demonstrate the legitimate business purpose or permitted use for accessing the RMV’s data. Your use of ATLAS is governed by the Agreement for Access to Records and Data Maintained by the Registry of Motor Vehicles (Access Agreement) signed by your company.  Any violator of this policy may be subjected to disciplinary actions, including termination of ATLAS accounts, criminal proceedings, and/or fines for each violation.

Certification effective July 1, 2023:

In accordance with under Section 7 of Chapter 81 of the Acts of 2022, and implementing regulations contained in 940 CMR 37.00, you and your employees, agents, or contractors (collectively, “End Users”) are not permitted to access or use these records for the purpose of enforcing federal immigration law nor may you provide information to an agency that primarily enforces immigration law, unless the Registrar is provided with a lawful court order or judicial warrant signed by a judge appointed pursuant to Article III of the United States Constitution.

You certify under the pains and penalties of perjury, that before any such access or use of said records, you shall not:

(i) Use such records or information for the purpose of enforcing federal immigration law; or

(ii)  Disclose said records or information to any agency that enforces immigration law or to any employee or agent of any such agency, unless the officer, employee, agent, or contractor is provided with a lawful court order or judicial warrant signed by a judge appointed pursuant to Article III of the United States Constitution:

(iii) Allow any End Users to access said records or information unless they shall certify    compliance with representations of subparagraphs (i) and (ii).

Violation of this certification and/or policy shall be unlawful. The Registrar shall immediately deny or revoke access to information to any individual or entity that the Registrar has reason to believe will or has violated such certification.

By logging in, and accessing RMV data and records, I certify under the pains and penalties of perjury that I will comply with the above requirements.
