Summary process: Housing Court forms
This is a sample only. The form, which must be purchased from the clerk's office of the court where you want to file, is for use in Housing, District, and Boston Municipal Courts.
For use in Housing Court. By signing this form, parties agree that a member of the Housing Specialist Department is to be assigned to look into the matter in this case. All parties expressly agree that the factual findings of the Housing Specialist are binding and final.
Agreement for judgement in a summary process (eviction) case. Once approved by the judge, this agreement becomes a court order and both parties are legally required to follow it.
This form is used in Housing Court when a judgment enters and a judge or clerk must determine a defendant/debtors ability to pay.
Where the complaint sets forth a claim for rent and/or use and occupation, the plaintiff shall file an affidavit stating the aggregate amount of payments, if any, which have been made subsequent to the date of the commencement of the action on account of such amount.

Instructions for the use of the Military Affidavit form, which may be used in all case types where the filing of a Military Affidavit is applicable.
Housing Court form for use in summary process to ask the court to issue an execution for possession plus rent/use and occupancy payments.
For use in Housing Court to request that the court remove a default judgment against you.
Used by the plaintiff to voluntarily discontinue an action in the Housing Court, and dismiss the complaint without prejudice.
Housing Court Form Rev 7/99. Provides an optional referral to a Housing Specialist. The Housing Specialist Department can sometimes help a complainant and defendant arrive at an agreement satisfactory to both.
An agreement between a landlord and tenant in Housing Court stipulating the rent that will be paid and repairs that will be made. Once approved by the judge, this agreement becomes a court order and both parties are legally required to follow it.
This form is filed by the tenant in response to a summary process complaint. It provides space for the tenant to list defense and counterclaims to the complaint.
Housing Court civil contempt summons pursuant to Mass. R. Civ. P. 65.3 for use in a summary process action.
Use this form when the plaintiff and defendant choose to waive a jury trial previously claimed in a Housing Court case.
