345 CMR 3.00 implements sections of the Massachusetts Low-Level Radioactive Waste Management Act, M.G.L. c. 111H, governing the criteria and procedures for selection of an operator for any facility at a superior site, so as to: (1) permit any site community to select the operator and technology or technologies that best ensure proper facility operation in order to protect public health, safety and the environment; (2) establish criteria for certifying applicants to design, construct, and operate a low-level radioactive waste management facility; (3) ensure an open and fair process for certifying such applicants.
