The role of the Board of Appeal is to conduct hearings for consumers appealing:

  • Any decision of the Registrar of Motor Vehicles
  • An insurance cancellation issued to a consumer by their insurance company

At-Fault Accident Appeals

An “At-Fault Accident Surcharge” is applied to those drivers that have been in an accident where their insurance company has determined that they are greater than 50% at fault. The Board of Appeal provides a venue through which those drivers who believe they are not greater than 50% at fault can dispute that surcharge. Instructions for filing a surcharge appeal are found on the surcharge notice mailed to you by your insurance company.

License Revocation Appeals

The Board of Appeal has jurisdiction to entertain appeals from any and all decisions or rulings of the Registrar of Motor Vehicles. The Board reviews applicable law, sworn testimony and relevant documentation from both a Registry of Motor Vehicles representative and the appellant. After the hearing, the Board decides whether to affirm the Registry’s decision or ruling, or whether to modify their decision in any way.

Insurance Cancellation Appeals

The Board of Appeal also has jurisdiction to entertain appeals from decisions by insurance companies to cancel your insurance policy and will make a determination following a hearing whether that cancellation was appropriate.
