Section 28E

After the execution of a surrogacy agreement and before the date of termination of the surrogacy agreement pursuant its terms or 180 days after the birth of a child conceived by assisted reproduction under the surrogacy agreement, whichever occurs earlier, the court conducting a proceeding under sections 28 to 28P, inclusive, shall have exclusive, continuing jurisdiction over all matters arising out of the surrogacy agreement; provided, however, that the court shall not have jurisdiction over a child custody or child support proceeding if jurisdiction is not otherwise authorized by the laws of the commonwealth.
