Overview
The electric companies may construct, own, and operate solar generation facilities. G.L. c. 164, §1A(f). Each electric company may own up to 35 megawatts (MW) of solar facilities, as long as the electric company received approval from the DPU for the solar facilities before December 31, 2016 and has constructed the solar facilities before December 31, 2019.
An electric company may recover the costs associated with constructing, owning, and operating its solar facility if the DPU pre-approves these costs. To pre-approve cost recovery, the DPU must determine that: the proposed solar facility is consistent with the Commonwealth’s energy policy and could be used to meet, in part, the renewable energy portfolio standard requirements of G.L. c. 25A, § 11F.
History
G.L. c. 164, § 1A(f) was added by the Green Communities Act of 2008. St. 2008, c. 169, § 58. The Legislature amended Section 1A(f) several times:

Initially, each electric company could not have more than 25 MWs. That is now not more than 35 MWs.

Originally, there was no date by which an electric company needed to seek DPU pre-approval for the proposed solar generation facilities. Now, an electric company must seek DPU pre-approval for solar generation facilities by December 31, 2016.

Initially, there was no date by which an electric company needed to construct the solar generation facilities after receiving DPU pre-approval. Now, the electric companies must construct the pre-approved facilities by December 31, 2019.
