Overview
Citable “automobile law violations”
The offenses in this table are citable on the Massachusetts Uniform Citation. Note that not every offense relating to motor vehicles must (or may) be cited on a citation, but only those in which one element of the offense involves the “operation or control” of a motor vehicle. G.L. c. 90C, §1 defines a citable “automobile law violation” as “any violation of any statute, ordinance, by-law or regulation relating to the operation or control of motor vehicles other than” parking violations and c.159B motor carrier violations. “[T]he mere fact that an offense involves a motor vehicle does not ipso facto make it an automobile law violation [unless] the thrust of [the offense is] aimed at regulating the manner in which automobiles are operated on a public way.” Commonwealth v. Giannino, 371 Mass. 700, 702-703, 358 N.E.2d 1008, 1010 (1977).
For purposes of G.L. c. 90C, recreation vehicles, snow vehicles, and motorized bicycles and scooters are motor vehicles.

- Civil motor vehicle infractions (CMVIs) citable under G.L. c. 90C, § 3(A) are identified in this table with an asterisk (*). A CMVI is “an automobile law violation for which the maximum penalty does not provide for imprisonment” except for:
- Unlicensed Operation (G.L. c. 90, §10, ¶1)
- Operating After Suspension or Revocation (G.L. c. 90, §23)
- Refusing to Stop for an Officer (§25)
- Uninsured Motor Vehicle (§34J)
- Violations “committed by a juvenile under the age of seventeen who does not hold a valid operators license.” G.L. c. 90C, §1.
The scheduled assessment for each CMVI is indicated in the “Assesment” column of this table. The scheduled assessment is the amount which the citing officer must enter on the citation (G.L. c. 90C, §3[A][2]), which the motorist must pay unless he or she asks for a hearing (§3[A][3]), and which a magistrate or judge must impose after finding the motorist responsible after a hearing except where a reduction from the scheduled assessment is authorized by District Court guidelines (§3[A][4]). Those guidelines are contained in District Court Administrative Regulation 3-86. The scheduled assessment for each CMVI is established jointly by the Chief Justice of the District Court Department and the Registrar of Motor Vehicles, and may be less than, but may not exceed, the maximum amount authorized by statute. G.L. c. 90C, §1. In this table, a “**” next to the schedule assessment indicates that the assessment has been set at less than the potential maximum.
