  1. Amorello, Matthew Docket No. 07-0032
    Former Massachusetts Turnpike Authority Chairman Matthew Amorello fined $2,000 for participating in revising the Turnpike Authority's sick leave buyback policy while having a financial interest in the policy change.
  2. Anderson, Joan Docket No. 09-0005
    Westminster Conservation Commission member Joan Anderson fined $2,000 for participating in matters in which she and her husband had financial interests, and for participating in matters affecting businesses with whom she and her husband had business dealings.
  3. Arlos, Peter Docket No. 05-0004
    Former Berkshire County Treasurer Peter Arlos fined $1,000 and forfeited $1,200 for voting as a Berkshire County Retirement Board member to increase his own salary.

  5. Atkinson, James Public Education Letter
    The Commission issued Public Education Letters to former Methuen City Councilors James Atkinson, James Jajuga, and Lynn Vidler to resolve allegations they violated section 19 of the state conflict of interest law when they participated in two 2017 City Council votes to approve the Methuen Police Department Superior Officers’ collective bargaining agreement. According to the letters, the three former councilors relied on incorrect legal advice from the Methuen city solicitor when they voted on the Superior Officers’ CBA. Atkinson, Jajuga and Vidler were prohibited from voting on the Superior Officers’ CBA because at the time of the votes Atkinson had a pending offer to work for the Methuen Police Department and Jajuga’s son and Vidler’s husband were superior officers in the Department.

    Mendon police officer J. Martin Auty fined $500 for participating in hiring his stepdaughter.
  7. Aylmer, John F. Public Enforcement Letter 90-7
    The State Ethics Commission issued a Public Enforcement Letter to Massachusetts Maritime Academy President John F. Aylmer in connection with his taking personal friends and family members on two Academy training cruises as "observers."
  8. Baez, Priscilla Docket No. 10-0006
    School Committee member voted on two occasions to approve the creation of the Special Assistant position and, at the time of such votes, knew that the superintendent planned to appoint her brother to the new position, and that the new position would include a pay increase.

    A former building inspector found to have violated G.L. c. 268A, section 19 for issuing permits for new construction work when he had been hired in his private capacity to do the work.

    Swansea Planning Board member fined $6,000 for violating the conflict of interest law by participating in matters that affected two private companies in which he had a financial interest.
  11. Banas, Vicki Public Education Letter
    The Commission  issued a Public Education Letter to Department of Developmental Services (DDS) employee Vicki Banas to resolve allegations that Ms. Banas violated the conflict of interest law.  Ms. Banas, while a DDS Program Manager in the DDS Central/West Region, solicited quotes and approved work performed at DDS facilities by a company owned by a family member and another company owned by a close family friend, in possible violation of sections 6 and 23 of the confllict of interest law.

    A state employee found to have violated G.L. c. 268A, section 6 by acting as a board member on a variance application when he knew his son would be working on a plumbing project for which the variance was needed.
  13. Bates, Stanley Docket No. 480
    A police chief found to have violated G.L. c. 268A, section 19 for awarding town contracts to his son or to a company wholly owned and operated by his son.
  14. Bayko, Andrew Docket No. 139
    Municipal Wiring Inspector who also performed private electrical work in town, found to have violated G.L. c. 268A, sections 19, 23(d) and 23(e).
  15. Baylis, Robert Docket No. 07-0014
    Lancaster Board of Health member Robert Baylis was fined $2,000 and forfeited $1,800 for awarding a contract to mow the landfill, and then mowing the landfill and receiving payment for the work.

    Warren Selectman Francis Beaudry participated in wage issue that affected the financial interests of his wife's brother.
  17. Becker, Marc Docket No. 06-0023
    Webster Planning Board member Marc Becker fined $4,000 for endorsing "approval not required" plans for two properties for which he served as the listing real estate broker.
  18. Benjamin, Robert Docket No. 24-0018
    The Commission approved a Disposition Agreement in which former Topsfield Parks and Cemeteries Commissioner Robert Benjamin paid a $14,000 civil penalty for violating §§ 19, 20, and 23(b)(2)(ii) by approving the transfer of town cemetery plots to himself at a discounted cost.
  19. Bernard, Paul A. Docket No. 284
    Freetown Planning Board member acknowledged he violated section 17 of G.L. c. 268A when, in his private capacity as a real estate broker, he represented private clients before his own board. Bernard agreed he also violated section 19 of G.L. c. 268A when he took steps, as a board member, to further the goals of two development proposals in which he, as a real estate broker, had a financial interest.
  20. Blanchette, David Docket No. 24-0002
    The Commission approved a Disposition Agreement in which former Lawrence Fire Department Fire Prevention Inspector David Blanchette agreed to pay a $65,000 civil penalty for violating sections 17(a), 19, and 23(b)(2)(ii) of the conflict of interest law multiple times by using his official position to secure business for his private smoke and carbon monoxide detector maintenance and installation company, conducting inspections on behalf of the Fire Department on properties where his private business had done pre-inspection work, and through other actions.
  21. Bossi, Ruthanne Docket No. 652
    The Commission fined former Billerica Building Inspector Ruthanne Bossi $10,000 for violating the state's conflict of interest law by reviewing and approving permit applications submitted by her brother, George Allen, a Billerica developer.
  22. Brawley, Henry A. Docket No. 152
    A municipal employee violated sections 23(a) and 19 by, in his private capacity, performing surveying work for a firm under contract with his own municipal agency and by participating in the agency's decisions (e.g., change orders), regarding that same firm.

    Marlboro Department of Community Development Finance Assistant Maureen Brennan fined $5,000 for participating in a rehabilitation loan application filed by her fiance-then husband.

    A state employee found to have violated G.L. c. 268A, section 6 by participating in a matter that affected his children's financial interest.
  25. Briggs, Sherman E. Docket No. 13-0006
    Marion Conservation Commission member cited for conflict of interest law violations after being paid to perform excavation work at a private school after participating, as a ConCom member, in approving the project.
  26. Brougham, Harry L. Docket No. 586
    Municipal Water District Commission member admitted to violating the conflict of interest law by participating in approving payments to a vendor company owned by his son.
  27. Buckley, John Docket No. 20-0010
    The Commission approved Disposition Agreements in which Templeton Planning Board members Kirk Moschetti, Frank Moschetti, and John Buckley admitted to violating Section 19 of the conflict of interest law by participating in Planning Board decisions related to proposals to re-zone areas where they and their families owned property. Planning Board Chair Kirk Moschetti paid a $5,000 civil penalty, and Frank Moschetti and Buckley have each paid a $2,000 civil penalty.

    Municipal Plumbing and Gas Inspector fined $1,500 for inspecting his brother's work.
  29. Burgess, Richard Docket No. 417
    A real estate agent and planning board member found to have violated G.L. c. 268A, section 19 by acting as a planning board member of plans for properties that were sold by him or his private sector employer.
  30. Burgmann, Robert Docket No. 462
    A former planning board chair found to have violated G.L. c. 268A, section 19 for sending an official memorandum to the town's board of health asking them to require that a local developer install a nitrate reducing septic system designed by a company that he worked for and partially owned.
  31. Bush, Elaine Docket No. 530
    Millbury Athletic Director Elaine Bush violated section 19 by participating in interviewing candidates for the position of high school girls basketball coach and forwarding the list of candidates to the school superintendent.  Bush's daughter was one of the candidates for the job, and she was subsequently hired for the position by the superintendent.

    A selectman found to have violated G.L. c. 268A, section 19 by participating in matters that affected his firefighter son's financial interests, and in liquor license matters in which he himself had a financial interest.
  33. Byrne, Michael Docket No. 23-0001
    The Commission issued a Final Decision and Order allowing a Joint Motion to Dismiss and approving a Disposition Agreement in which former Arlington Inspectional Services Department Director Michael Byrne admits to violating sections 19, 23(b)(2)(ii), 23(b)(3), and 26 of the conflict of interest law by allowing his own plumbing company to do work without permits or inspections at more than three-dozen Arlington sites, creating false permits for work his company performed, and through other actions. The Commission accepted Byrne’s payment of an $80,000 civil penalty and dismissed the adjudicatory proceeding against him.
  34. Cabral, Francisco Docket No. 677
    Former Fall River Wiring Inspector Francisco Cabral fined $750 for inspecting his son's electrical work.
  35. Caissie, Jennie Public Education Letter
    Municipal Selectman cited for participating in permitting a fruit stand business that competed with her family's fruit stand business.
  36. Caliri, Michael A. Docket No. 613
    A municipal school department director of maintenance and custodial services violated G.L. c. 268A, section 19, 23(b)(2) and(b)(3) for seeking and receiving services from subordinates and a school department vendor in connection with the construction of his new home, and for supervising his brother.
  37. Callahan, Francis P. Docket No. 653
    Ayer Commissioner of Trust Funds violated G.L. c. 268A, section 19 by investing $90,000 of the trust funds' money with New England Securities, the licensed broker/dealer of securities for his employer, New England Financial.
  38. Campanini, Eileen Docket No. 705
    Bridgewater Zoning Board of Appeals member violated section 19 when she participated in a matter where she had a financial interest.
  39. Capman, Mary Docket No. 11-09
    Former Gardner Golf Commission member admitted to violating G.L. c. 268A, section 19 by not filing a disclosure regarding the financial interest of a family member prior to facilitating a financial gain for that family member through her position.
  40. Carnevale, Jeanne Docket No. 20-0001
    The Commission approved a Disposition Agreement in which former Peabody City Treasurer Jeanne Carnevale admitted to violating the conflict of interest law by using her public position, city funds, and other public resources in three sales of tax-delinquent Peabody properties which financially benefited her family and associates. Carnevale paid a $50,000 civil penalty.
  41. Carroll, Charles, Docket No. 20-0008
    The Commission issued a Final Order approving a Disposition Agreement in which Templeton Planning Board member Charles Carroll admitted to violating section 23(b)(3) of the conflict of interest law by participating in Planning Board decisions related to proposals to rezone an area of town where his father owned property. The Commission accepted Carroll’s payment of a $1,500 civil penalty and dismissed the adjudicatory proceeding against him.
  42. Cassidy, Peter J. Docket No. 333
    Swampscott Police Chief Peter Cassidy violated section 19 by recommending four of his sons to positions on the police force.
  43. Cataldo, Edward Docket No. 07-0020
    Leominster Director of Inspections Edward Cataldo fined $3,000 and forfeited $300 for advertising his energy code audit business at the inspections office, receiving compensation from clients for performing energy code audit work that was then submitted with building permit applications, and for reviewing his energy code audit work along with building permit applications.
  44. Cellucci, Joseph D. Docket No. 335
    Cambridge Inspectional Services employee Joseph Cellucci violated section 19 by attempting to control jurisdiction over inspection and enforcement of the state's sanitation code for a property owned by members of his immediate family.
  45. Chase, Dana G. Docket No. 196
    The Order to Show Cause alleged that the Respondent, a member of the Board of Selectmen of the Town of East Bridgewater, violated G.L. c. 268A, sections 19 and 23 by a participating as a municipal employee in certain particular matters in which he and the real estate firm he owned and operated in his private capacity had a financial interest. The Commission found that the Respondent did not violate G.L. c. 268A, sections 19 and 23.
  46. Christianson, Jr. Carl G. Docket No. 07-0030
    Rutland DPW Supervisor violated G.L. c. 268A, sections 19 and 23(b)(2) by hiring his son for a town position that was not publicly posted.
  47. Cibley, Lawrence J. Docket No. 374
    A chairman of the board of selectmen found to have violated G.L. c. 268A, section 23 by trying to fix a speeding ticket given to a friend.
  48. Cimeno, Kenneth Docket No. 359
    Dedham Assistant Building Inspector Kenneth Cimeno violated G.L. c. 268A, section 19 by signing and issuing building permits for two sites owned by a realty trust for which he and his parents served as trustees.
  49. Coelho, Paul Docket No. 697
    Norfolk Building Commissioner violated sections 18(a) & 19 when he participated in matters involving his future private employment.
  50. Colella, George Docket No. 368
    A mayor found to have violated G.L. c. 268A, section 19 for hiring and supervising his daughter.
  51. Colon Hayes, Karen Docket No. 23-0011
    The Commission approved a Disposition Agreement in which former Malden Human Services and Outreach Director Karen Colon Hayes paid a $7,500 civil penalty for violating sections 19 and 23(b)(3) of the conflict of interest law by hiring her two daughters and one daughter’s boyfriend for jobs with the city youth employment program she managed.
  52. Columbus, Robert Docket No. 468
    Stoneham Building Inspector Robert Columbus violated G.L. c. 268A, section 19 for issuing building permits to himself and his two sons.
  53. Comtois, Stephen Docket No. 19-0003
    The Commission issued a Decision and Order finding that former Brookfield Selectman Stephen Comtois violated sections 19 and 23(b)(2)(ii) of the conflict of interest law when he acted as a Selectman concerning the proposed donation to the town of land he was interested in buying and used his official position to derail the proposed donation in order to privately purchase it himself for substantially less than its assessed value. The Commission ordered Comtois to pay a $20,000 civil penalty.
  54. Connors, Brian Public Education Letter
    East Bridgewater Special Police Officer had prohibited financial interests in contracts with the police department through his company, Flagship Security Systems, Inc.; also participated in preparing bid specifications for a contract he knew his company would bid on.
  55. Corbosiero, Guy Docket No. 10-0013
    Municipal Planning Board member, violated G.L. c. 268A, section 19 by participating in a particular matter concerning the Overlay District, which involved properties that were, respectively, across the street and a block away from his sister's House.
  56. Coughlin, Marguerite Docket No. 331
    A planning board member found to have violated G.L. c. 268A, section 19 by voting on a zoning matter affecting her neighbor.
  57. Craven, Jr., James J. Docket No. 110
    The Ethics Commission decided constitutional issues raised by the respondent, and then found that the respondent, State Representative James J. Craven, Jr., violated sections 6 and 23 by using his position to pressure EOCD officials to provide state funding for a community development corporation , Jamaica Plain Community Development Foundation, founded by Craven's legislative aide, which rented space in a building owned by Rep. Craven's siblings.  The Commission found that Rep. Craven did not violate section 2 in connection with this matter.
  58. Crean, Thomas Docket No. 06-0015
    Former Beverly Mayor fined $1,000 and reimbursed the city $500 for directing that the Purchasing Director declare his laptop computer as surplus property and allowing him to purchase the laptop for $100.
  59. Cronin, Jr., Frederick B. Public Education Letter 87-1
    The Commission issued a Public Enforcement letter concluding that, Lynn city tax collector violated the conflict of interest law by hiring his brother as his assistant.
  60. Crossman, David Docket No. 442
    A former member and chair of a conservation commission found to have violated G.L. c. 268A, section 17(a), section 18(a), section 19 and section 23(b)(3) for his private consulting work in connection with the state's Wetland Protection Act.
  61. Cunningham, George Docket No. 154
    A municipal employee violated section 19 by participating in discussions and decisions relative to the award of a municipal contract to his wife's company and violated section 20 by subcontracting through his own company to do work for the town.

    A Tyringham Board of Selectmen member found to have violated G. L. c. 268A, section 19 by participating in a particular matter in which he had a financial interest.

    Former Randolph Housing Authority Executive Director fined $5,000 for attempting to purchase property from a Housing Authority applicant and for participating in matters affecting applicants that were at the time renting from his father.
  64. D'Amico, Michael J. Docket No. 670
    Former Quincy City Councilor was fined $1,250 for violating G.L. c. 268A, section 19 the state's conflict of interest law.
  65. Davis-Hassan, Barbara Docket No. 23-0007
    The State Ethics Commission issued a Final Decision and Order allowing a Joint Motion to Dismiss and approving a Disposition Agreement in which Lanesborough Economic Development Committee Chair and Planning Board member Barbara Davis-Hassan admits to violating sections 17(c) and 19, of the conflict of interest law by participating as a Planning Board member in a proposal to rezone the Berkshire Mall while she privately had an exclusive marketing agreement to sell the property, by representing the mall’s owner in local tax and infrastructure matters, and by participating as a Planning Board member in a proposal to rezone a second property while privately serving as its listing agent. The Commission accepted Davis-Hassan’s payment of a $30,000 civil penalty and dismissed the adjudicatory proceeding against her.
  66. DeLorie, Richard, Docket No. 21-0004
    The Commission approved a disposition agreement in which  Wellesley Fire Chief Richard DeLorie admitted to violating sections 19 and 23(b)(2)(ii) of the conflict of interest law by participating in the town’s hiring of his son as a firefighter and using his official position to alter the hiring process to favor his son. DeLorie paid a $10,000 civil penalty.

    A former selectman found to have violated G.L. c. 268A, section 19 for signing his wife's employment contract for her job as a police department dispatcher.
  68. DeRosa, John Docket No. 19-0002
    The Commission approved a disposition agreement in which Former North Adams City Solicitor John DeRosa admitted that he violated section 17, 19, and 23 of the conflict of interest law by representing and doing compensated legal work for parties other than the city in connection with proposed North Adams redevelopment projects while he was City Solicitor, and by advising the city on those projects as City Solicitor during that same time. DeRosa paid a $7,500 civil penalty.

    Westford Affordable Housing Committee member was fined $5,000 and forfeited $3,862 for representing clients before the AHC.
  70. Desrosiers, Yvonne B. Docket No. 345
    A Treasurer/Collector found to have violated G.L. c. 268A, section 19 for hiring her son.
  71. DiPasquale, Julie A. Public Education Letter
    Somerville School Committee member cited in a Public Enforcement Letter for participating in matters affecting her family members financial interests.
  72. Dickinson, Delwin Docket No. 13-0011
    The former Hosting Services Director for the Commonwealth of Massachusetts Information Technology Division (“ITD”), admitted to violating the conflict of interest law, by awarding contracts and approving payments to hardware and software reseller Advizex after entering into employment negotiations with the company.
  73. Donaldson, Robert Docket No. 463
    A former health agent found to have violated G.L. c. 268A, section 19 for witnessing numerous percolation tests on land that was either already listed with his real estate agency or that he knew or expected would be listed with the agency once the percolation tests were successful.

    Brockton Building Commissioner fined $3,000 for inspecting work done by his son.
  75. Doyle, Patricia A. Docket No. 606
    Weymouth Parks Commissioner fined $500 for participating in reclassifying a family members job from park ranger to park superintendent.
  76. Duarte, Bruce Docket No. 13-0009
    The State Ethics Commission issued a Decision and Order finding that Bruce Duarte, a senior property manager at the New Bedford Housing Authority, violated section 19 of G.L. c. 268A, the conflict of interest law, by directing NBHA staff to stop the eviction of his brother from an NBHA apartment.  The Commission ordered Duarte to pay a civil penalty of $1,000.  
  77. Dubay, Francis H. Docket No. 676
    Erving Selectman fined $1,000 for participating in his appointment by the Selectmen as the part-time, paid, assistant town treasurer.
  78. Duggan, Joseph Docket No. 527
    Hull Lighting Plant General Foreman violated G.L. c. 268 A, section 19 by participating in a particular matter where his immediate family members had a financial interest.
  79. Emerson, Christine Docket No. 22-0008
    The Commission approved a Disposition Agreement in which Cheshire Town Clerk Christine Emerson paid a $5,000 civil penalty for violating section 19, 23(b)(2) and 23(b)(3) of the conflict of interest law by hiring her daughter and granddaughter to perform work for the town on multiple occasions.

    Dracut Water Commission member participated in hiring and supervising his son.
  81. Erbetta, Robert Public Education Letter
    Public Education Letter issued to a former member of the Board of Trustees, of the Marblehead Community Charter Public School, to resolve allegations that he violated the conflict of interest law by performing private construction-related work for the school while he was a member of the Board.
  82. Esposito, Michele Docket No. 421
    Former Department of Revenue (DOR) employee Michele Esposito fined $500 for negotiating future employment with technical consulting firm Maximus Inc., while she was co-contract administrator for a $4.8 million contract Maximus had with DOR. 
  83. Fahey, William Docket No. 23-0008
    The Commission approved a Disposition agreement in which former Andover Youth Services Director William Fahey paid a $20,000 civil penalty for violating §§ 17, 19, 23(b)(2)(i), and 23(b)(2)(ii) of the conflict of interest law by receiving payments from a private nonprofit in connection with his employment with the Town of Andover and by allocating the payments to himself and members of his municipal staff. 
  84. Farley, Robert Docket No. 255
    The acting supervisor of the Division of Elevator Inspections in the Department of Public Safety admitted he violated section 6 of G. L. c. 268A by inspecting several hundred elevators either built or maintained by companies which were employing him privately.

    The Commission approved a Disposition Agreement in which Wareham Public Schools Director of Student Services Melissa Fay paid a $4,000 civil penalty for violating the conflict of interest law by hiring her mother and participating in hiring her son for jobs in the school district.
  86. Fernandes Anderson, Tania 23-0012
    The Commission approved a Disposition Agreement in which Boston City Councilor Tania Fernandes Anderson admitted to violating section 19 of the conflict of interest law by hiring her sister and son to paid positions on her Boston City Council staff. Fernandes Anderson agreed to pay a $5,000 civil penalty.
  87. FitzPatrick, Malcolm Public Enforcement Letter 91-1
    The Ethics Commission finds reasonable cause to believe Stow Selectman Malcolm FitzPatrick violated the conflict of interest law by participating during several public meetings in discussions over a housing development that could have impacted his private property.
  88. Fleming, Erik Docket 21-0006
    The Commission issued a Final Order approving a Disposition Agreement in which Hardwick Planning Board member Erik Fleming admits to violating Section 19 of the conflict of interest law by participating in the Planning Board’s approval of a site plan for new construction at a private school where he serves as a member of the Board of Trustees. The Commission accepted Fleming’s payment of a $5,000 civil penalty and dismissed the adjudicatory proceeding against him.
  89. Fleming, Thomas Docket No. 18-0007
    Northern Essex Community College Police Academy Director Thomas Fleming paid a $5,000 civil penalty after admitting he violated two sections of the conflict of interest law by recommending the college purchase training gear for the Academy from his private employer, a sporting goods company, and by representing both the Academy and the company in those transactions. Fleming received commissions on the purchases.

    Winthrop Recreation Commission member John Forristall violated G.L. c. 268A, section 19 by selling janitorial supplies to the Recreation Department and collecting $1,125 in commissions for the sales.
  91. Foskett, Gerry Docket No. 16-0002
    The Commission approved a Disposition Agreement in which Gerry Foskett, the Town of Charlton Highway Department Superintendent, admitted to violating section 19 on multiple occasions, by hiring three of his brothers and his son to plow snow for the Town, and by hiring his son to build a retaining wall at the new Highway Department Barn.  Pursuant to the Agreement, Foskett paid a $7,500 civil penalty.

    Dover Municipal Well Inspector fined $2,000 for conducting well inspections for his private water company customers.

    Dighton Board of Selectmen chair Armand Gagne improperly had his university course work paid by the town's tuition reimbursement program.
  95. Ganem, Albert Public Education Letter
    The Commission authorized the issuance of a Public Education Letter to resolve allegations that Hampden-Wilbraham Schools Superintendent Albert Ganem violated sections 19 and 23 of the conflict of interest law by participating as superintendent in the hiring of his spouse and daughter.

    A former school department superintendent found to have violated G.L. c. 268A, section 19 and section 23(b)(3) for hiring and approving payments to her sister and by signing a contract and approving payments to a person with whom she shared an apartment.

    The Commission approved a Disposition Agreement in which Former Weston Selectman Douglas Gillespie admitted to violating sections 19, 23(b)(2)(ii), 23(c)(2), and 23(b)(3) of the conflict of interest law by repeatedly participating as a selectman in connection with matters affecting a proposed affordable housing development on property owned by him and his brothers, directing that Board of Selectmen meeting minutes be altered to conceal his conflict of interest, and using his selectman position provide his family an advantage in negotiating a sale of the property. Gillespie paid an $8,000 civil penalty.

    The Commission issued a Final Decision and Order finding that Aquinnah Select Board member Gary Haley violated section 19 by selecting himself to install underground conduits for utility wires for the town and by approving the town’s payment of his $17,445 invoice for the work. The Commission ordered Haley to pay a $10,000 civil penalty for the violations. The Commission found it was not proved that Haley violated sections 20 and 23(b)(4) as alleged.

    The Commission issued a Decision and Order finding that former Stoughton Town Moderator Howard Hansen violated sections 19, 20 and 23 of the conflict of interest law and imposed a $4,000 civil penalty.

    A municipal building commissioner violated section 19 by issuing three permits for, and carrying out seven inspections of, construction projects performed by his son. In light of the ten individual instances of improper conduct.
  117. Jajuga, James, Public Education Letter
    The Commission issued Public Education Letters to former Methuen City Councilors James Atkinson, James Jajuga, and Lynn Vidler to resolve allegations they violated the state conflict of interest law when they participated in two 2017 City Council votes to approve the Methuen Police Department Superior Officers’ collective bargaining agreement. According to the letters, the three former councilors relied on incorrect legal advice from the Methuen city solicitor when they voted on the Superior Officers’ CBA. Atkinson, Jajuga and Vidler were prohibited from voting on the Superior Officers’ CBA because at the time of the votes Atkinson had a pending offer to work for the Methuen Police Department and Jajuga’s son and Vidler’s husband were superior officers in the Department.

    Middleborough Assessor, Jacob Kulian admitted to violating the conflict of interest law by taking actions that reduced his property taxes. Kulian paid an $8,000 fine and reimbursed the town of Middleborough $2,215 for property tax abatements and reductions he was not entitled to receive.

    Palmer Redevelopment Authority Chairman Blake Lamothe admitted to violating G.L. c. 268A, the conflict of interest law, by participating as a PRA member in efforts to secure millions of dollars in state funding to revitalize Union Station, a train depot he owns.  Pursuant to the Disposition Agreement, Lamothe paid a $5,000 civil penalty.

    Somerville City Solicitor violated section 19 by participating in a matter affecting her spouse's financial interests.

    The Commission approved a Disposition Agreement in which Dr. Heather Larkin, former Director of Guidance and Pupil Personnel Services at Greater New Bedford Regional Vocational Technical High School, paid a $10,000 civil penalty for violating sections 19, 23(b)(3), and 23(b)(2)(ii) of the conflict of interest law by contracting with her friend and business partner to provide services to the school, using the school’s resources to promote her private business event, and through other actions.

    The Commission approved a Disposition Agreement in which Agawam Junior High School Band Director Kenneth Michna admitted to violating sections 17, 19, and 23 of the conflict of interest law by accepting $1,750 in payments from a nonprofit organization for helping to organize and judge a series of band competitions during his public work hours, and by giving a $2,000 payment for the school’s music department to a private, parent-run booster association. Michna paid a $2,500 civil penalty.

    The Commission approved a Disposition Agreement in which Hanson Selectman Kenneth Mitchell Sr. admitted to violating sections 17 and 19 of the conflict of interest law by authorizing town payments to the tree service company he privately worked for, representing his private employer in a matter involving the town, and acting as a selectman to advance a proposal to remove trees on town land while knowing his private employer would likely be hired to do the work. Mitchell paid a $5,000 civil penalty.

    The Commission approved a Disposition Agreement in which Former Pepperell Selectman Roland Nutter admitted to violating sections 19 and 23 of the conflict of interest law by voting against authorizing the investigation of a grievance involving his wife, the town Treasurer-Collector, and by participating in matters affecting her employment contract and salary. Nutter paid a $6,000 civil penalty.

    Former Templeton Board of Selectmen member and Municipal Building Study Committee member Dennis O’Brien admitted to violating section 19 by participating in the Town’s purchase of a vacant factory building located directly across the street from the O’Brien residence.

    The State Ethics Commission has issued a Final Order approving a Disposition Agreement in which former Sandisfield Highway Road Superintendent Robert O’Brien admits to repeatedly violating the conflict of interest law by deciding to hire his private business to provide services to the town more than 90 times, signing off on town payments to his business more than 40 times, using inside town information to underbid competitors for a town contract, using his public position to solicit private work, and having the town billed for materials his business used to do private jobs. The Commission accepted O’Brien’s payment of a $50,000 civil penalty and dismissed the adjudicatory proceeding against him.

    The Commission approved a Disposition Agreement in which Daniel O'Connell, former Superintendent-Director of the North Shore Technical High School and Essex North Shore Agricultural & Technical School districts, admitted to violating sections 19 and 23 of the conflict of interest law by directing a subordinate to reinstate his expired  stipend; by giving his son pay raises and increased opportunities to work overtime; by allowing his son to use a school truck for private business; by using his position to pressure a plumbing supply company in a personal dispute; and by ordering school employees to use public worktime and resources to deliver surplus bricks to his home. O'Connell paid a $23,000 civil penalty.

    The chairman of a state licensing board was assessed a $2,000 civil penalty in connection with his admission that he violated section 6 of the conflict law. In particular, that individual acknowledged that in the winter of 1982-1983, he took a licensing exam, the answers to which he, as a board member, had helped to establish. After completing the exam, he graded his own paper and issued himself a license.
  192. Pipczynski, Donald Docket No. 19-0001
    The Commission approved a Disposition Agreement in which former Hadley Select Board member Donald Pipczynski admitted to violating  sections 23(b)(2)(ii) and 19 of the conflict of interest law by invoking his official position to threaten a private club that expelled him, and by voting as a Select Board member against forwarding complaints about his conduct to the State Ethics Commission. Pipczynski paid a $5,000 civil penalty.
  193. Pizzi, Laureen Public Education Letter
    The Commission issued a Public Education Letter to Laureen Pizzi, former Director of Management/Resident Services Coordinator at the Weymouth Housing Authority, after finding reasonable cause to believe she violated  sections 19, 23(b)(2)(ii) and section 23(b)(3) of the conflict of interest law by, on three separate occasions, leasing Weymouth Housing Authority apartments to individuals with whom she had personal connections, even though they were not eligible for the housing.

    Chelsea City Councilor Stephen Powers paid a $1,000 civil penalty for violating section 23 by seeking to establish short-term parking spaces outside S&L Subs, a sub shop co-owned by his wife.
  196. Prue, Richard Docket No. 14-0008
    The State Ethics Commission approved a Disposition Agreement in which Richard Prue, the transportation director of the Greater Lawrence Educational Collaborative admitted to repeatedly violating G.L. c. 268A, the conflict of interest law by, as transportation director, approving payments to a transportation vendor, which employed his wife as a bus monitor.  Pursuant to the Agreement, Prue paid a $5,000 civil penalty.
  197. Prunier, George, Public Education Letter 88-1
    Grafton Selectman George Prunier violated G.L. c. 268A, section 19 by participating in the deliberations and negotiations for the town's purchase of a private landfill site directly across the street from his home.
  198. Race, Clarence Docket No. 327
    A selectman and chairman found to have violated G.L. c. 268A, section 19 for sending a letter under his official signature as chairman to a state agency concerning a parcel of land that he owned.
  199. Recore, Omer H. Jr. Docket No. 656
    The Commission fined Milford Police Sgt. Omer H. Recore, Jr. $1,000 for violating the state's conflict of interest law by preparing a police report for a motor vehicle accident involving his wife. In a Disposition Agreement, Recore admitted that he violated G.L. c. 268A, § 19 by preparing an official police report on December 6, 2000 for an automobile accident that took place on the previous day and involved his wife Elaine Recore.

    A municipal employee found to have violated G.L. c. 268A, section 19 for awarding town contracts to two companies he personally owned and operated, and for attempting to conceal his financial interests in the contracts.
  201. Renna, Robert G. Docket No. 622
    Former Program Director of the Lexington-Arlington-Burlington-Bedford-Belmont Collaborative (LABBB), paid a $4,000 civil penalty to resolve allegations that he violated the conflict of interest law by using LABBB resources and funds to operate Northeast Reality Therapy Associates (NERTA), a private business association formed by Renna, two of his LABBB subordinates and a LABBB consulting psychologist.
  202. Richenburg, Henry Docket No. 15-0002
    Salisbury Selectman Henry Richenburg paid a $2,500 civil penalty for violating sections 19 and 23 of the conflict of interest law by participating as a selectman in tabling, and then approving, an application for a poultry business license submitted by his son-in-law, where Richenburg's daughter was employed by the business, and where the property on which the poultry business operations would be conducted was owned by his daughter and son-in-law, as well as on a portion of property owned by Richenburg.

    Revere School Committee member Anthony Rizzo found to have violated section 19 for voting to create a school security guard position that he knew his son would occupy.

    Fairhaven School Committee member admitted he violated section 19 of G.L. c. 268A when, on several occasions, he participated in school committee discussions relating to a collective bargaining agreement which would affect the financial interests of his wife, who was a teacher in the Fairhaven school system.

    Hull Fire Chief James N. Russo fined $750 for violating the conflict of interest law by appointing his wife's brother to the position of "permanent intermittent" firefighter.
  211. Santos, Stephen Public Education Letter
    The Commission issued a Public Education Letter to Ludlow Department of Public Works Board Chairman Stephen Santos after finding reasonable cause to believe he violated sections 19 and 23 of the conflict of interest law by voting to elect himself as DPW Board Chairman and by participating in disciplinary matters involving a DPW employee he believed was cooperating with an investigation of him.

    A state representative found to have violated G.L. c. 268A, section 23(b)(3) and G.L. c. 268B by receiving illegal gratuities for himself and family members, by creating the appearance of conflict related to the gratuities, and by accepting gifts worth more than $100 from lobbyists and by failing to report the gratuities on his financial disclosure forms.

    A former member of the town tourism committee found to have violated G.L. c. 268A, section 19 for purchasing a series of commemorative plates for the town from companies he represented as a salesman, and for receiving commissions on the sales.

    The Commission issued a Final Order dismissing an adjudicatory proceeding against West Stockbridge Fire Chief and former Select Board member Peter Skorput and accepted a Disposition Agreement in which Skorput admitted to violating sections 19, 20, and 23 of the conflict of interest law by continuing to serve as Fire Chief after his election to the Select Board; deciding payment amounts for himself, his daughter, and his nephew; voting as a Select Board member to reappoint himself Fire Chief; terminating a firefighter who had filed a complaint against him; and through other actions.. Skorput paid a $5,000 civil penalty.
  220. Smith, Jr., Arthur R. Docket No. 522
    The Commission dismissed an adjudicatory matter involving Wilmington Water and Sewer Commission Chairman Arthur R. Smith, Jr., due to Smith's inability to consult with his lawyer or understand the proceedings against him.
  221. Smith, Bernard J. Docket No. 130
    Department of Public Health Nurse Recruiter Bernard Smith violated sections 4, 6 and 23 of the conflict of interest law by being paid by a private company as a nurse recruiter at the same time he was working as a nurse recruiter for DPH, and also by, on behalf of DPH, contracting with the private company to rent space at job fairs where he was also working for the private company.
  222. Smith, James H. Docket No. 425
    James H. Smith, a former member of the Woods Hole, Martha's Vineyard and Nantucket Steamship Authority, fined $4,000 for participating in a land acquisition that substantially benefited a business of which Smith was an officer and director.

    Uxbridge Selectman Ross Smith participated in selling a surplus school bus to himself through a straw business.
  224. Smith, Russell Docket No. 473
    A former chair of the board of selectmen found to have violated G.L. c. 268A, section 19 for his involvement in a town inquiry into the federal criminal investigation of his brother.
  225. Snell, Thomas Docket No. 15-0009
    The Commission approved a Disposition Agreement in which Thomas Snell, a member of the West Bridgewater Zoning Board of Appeals, admitted to violating the conflict of interest law, by participating as a ZBA member in granting variances for two properties while knowing that he had a financial interest in those matters.  Pursuant to the Agreement, Snell paid a $6,500 civil penalty for violating the conflict of interest law.

    North Attleboro wiring inspector fined for performing electrical and wiring work through his private company without first obtaining the proper permits.
  227. Straight, Matthew Docket No. 07-0005
    Fitchburg City Councilor Matthew Straight fined $2,000 for participating in License Commission matters on neighborhood bars near property Straight planned to redevelop from rental units into condominiums.
  228. Sullivan, Sr., Richard E. Docket No. 276
    The mayor of a small city admitted he violated G. L. c. 268A, section 19 when he appointed his son to a provisional position on the City's police department.
  229. Sullivan, Tara Docket No. 24-0001
    The Commission approved a Disposition Agreement in which Blackstone Town Clerk Tara Sullivan paid a $5,000 civil penalty for violating section 19 of the conflict of interest law by hiring her mother and sister as town election workers. 
  230. Sun, Gang Docket No. 12-0007
    Physics Professor at a UMass-Boston violated section 6 by hiring his wife to work as his research assistant and teaching assistant on numerous occasions without filing the proper disclosure and obtaining authorization from his appointing authority.
  231. Tardanico, Guy Docket No. 449
    A school committee member found to have violated G.L. c. 268A, section 19 by participating in school department contract negotiations with the bargaining unit to which he wife belonged.
  232. Tarmey, Edmund Docket No. 07-0012
    Former Lowell Regional Water Utility Executive Director Edmund Tarmey fined $2,500 for certifying contract performance which allowed his brother to collect sales commissions.
  233. Teague, Floyd Docket No. 24-0022
    The Commission approved a Disposition Agreement in which former Bristol County Deputy Sheriff Floyd Teague paid a $40,000 civil penalty and $25,000 in economic advantage damages for violating sections 6 and 23(b)(2)(ii) of the conflict of interest law by conducting a public auction in which he placed an absentee bid on behalf of his spouse for a seized modular home, then awarded her the home, which she later renovated with his help and sold at a profit. 
  234. Theroux, Richard Docket No. 22-0003
    The Commission approved a Disposition Agreement in which former Hampden County Regional Retirement Board Member Richard Theroux paid a $10,000 civil penalty for violating sections 6, 23(b)(2) and 23(b)(4) of the conflict of interest law by obtaining reimbursements from the Board for falsely claimed lodging expenses and, as a Board member, approving those reimbursements to himself.
  235. Thompson, James V. Docket No. 336
    A town counsel found to have violated G.L. c. 268A, section 17 by representing his private development company before the planning board in a request for a zoning change.
  236. Tivnan, Paul X. Docket No. 348
    A county commissioner found to have violated G.L. c. 268A, section 13 by voting to approve a request to fund promotional changes that affected the financial interests of his children.
  237. Touafek, Katherine Docket No. 19-0011
    The Commission approved a Disposition Agreement in which Katherine Touafek, Director of the School to Careers Partnership for the Blue Hills Regional Technical School District, admitted to violating section 19 of the conflict of interest law by repeatedly participating in hiring her son to do paid work for the Partnership. Touafek paid a $4,000 civil penalty.
  238. Traini, Suzanne Docket No. 691
    BOH member violated section 19 by participating in a matter where she had a financial interest.
  239. Tucker, Arthur Docket No. 369
    A building inspector found to have violated G.L. c. 268A, section 19 for participating in his official capacity in a dispute over alleged building code, property subdivision and safety violations involving a house that abutted his own property, and that he had expressed an interest in buying.
  240. Turner, Joseph Docket No. 10-0018
    According to the Decision, Turner violated the conflict of interest law by, as Division Foreman, selling four cemetery plots to his parents, and by using his Division Foreman position to secure the plots for his parents in violation of Town policy restricting sales for immediate need, and just before a price increase was to go into effect.
  241. Uppaluri, Radhika Docket No. 23-0003
    The Commission approved a Disposition Agreement in which Radhika Uppaluri, a former programmer and systems supervisor for the state Executive Office of Education (EOE), admitted to violating §§ 4(a), 6, 7, and 23(b)(2) of the conflict of interest law by as an EOE employee, hiring and supervising information technology (IT) consultants recruited by her family’s company. Uppaluri paid a $70,000 civil penalty.
  242. Vidler, Lynn Public Education Letter
    The Commission issued Public Education Letters to former Methuen City Councilors James Atkinson, James Jajuga, and Lynn Vidler to resolve allegations they violated the state conflict of interest law when they participated in two 2017 City Council votes to approve the Methuen Police Department Superior Officers’ collective bargaining agreement. According to the letters, the three former councilors relied on incorrect legal advice from the Methuen city solicitor when they voted on the Superior Officers’ CBA. Atkinson, Jajuga and Vidler were prohibited from voting on the Superior Officers’ CBA because at the time of the votes Atkinson had a pending offer to work for the Methuen Police Department and Jajuga’s son and Vidler’s husband were superior officers in the Department.
  243. Viens, Stephanie Docket No. 19-0009
    The Commission approved a Disposition Agreement in which South Hadley teacher Stephanie Viens paid a $7,000 civil penalty for violating sections 3, 17, and 19 of the conflict of interest law by accepting stipends and travel points from a private tour company for organizing school trips to Europe.
  244. Villamaino, Vincent Docket No. 21-0008
    The Commission approved a Disposition Agreement in which  former Hampden Selectman Vincent Villamaino admitted to violating sections 19 and 23 of the conflict of interest law by participating as a selectman in matters involving a country club he belonged to, had done private work for, and resided next to. Villamaino paid a $4,000 civil penalty.
  245. Vinton, Barry Docket No. 651
    A police chief found to have violated G.L. c. 268A, section 19 by recommend that his wife be hired as a police department clerk, by recommending that her position be funded and that her hours be increased and by approving warrants for payments to her.
  246. Walker, Randall Docket No. 19-0007
    The Commission approved a Disposition Agreement in which New Braintree Select Board Member Randall Walker admitted that he violated Sections 19 and 20 of the conflict of interest law by voting to authorize the sale of town-owned land he wished to buy, then privately purchasing that land from the town when it was publicly auctioned. Walker paid a $5,000 civil penalty.
  247. Walley, Kenneth Docket No. 649
    Revere Assistant Electrical Inspector Kenneth Walley entered into a Disposition Agreement in which he paid a $2,500 civil penalty for violating sections 17 (a) and (c) and 19 for performing electrical work in the city and then inspecting the work as Assistant Electrical Inspector.
  248. Walsh, David I. Docket No. 188
    A municipal water commissioner violated the conflict law by accepting payment from the town for three private construction jobs, by approving two of the payments, and by billing the town for tires purchased for his personal use.
  249. Walsh-Tomasini, Rita Docket No. 275
    In a Disposition Agreement between the Commission and a local school committee member, the latter admitted she violated section 19 of the conflict law first by appointing her son to a clerk/typist position on her own staff and again when she took action to grant him a retroactive pay raise.
  250. Wheeler, Richard Docket Number 09-0011
    Barre Department of Public Works Superintendent, Richard Wheeler admitted to violating the conflict of interest law, G.L. c. 268A, by attempting to use his official position to secure for himself an unwarranted privilege of substantial value and by participating in his official capacity in a matter in which he had a financial interest.
  251. Willauer, William Docket No. 11-0019
    The Ethics Commission approved a Disposition Agreement in which a Nantucket Board of Selectmen member admitted to violating G.L. c. 268A, the conflict of interest law, on several occasions by voting to award contracts to the Alliance for Substance Abuse Prevention and to the Family & Children’s Services of Nantucket County, Inc., doing business as Nantucket Behavioral Health Services, Inc. During the relevant time period, he was a member of the board of directors of ASAP, and he was the President of BHS.
  252. Winsor, Shawn Docket No. 07-0015
    Lancaster Board of Health member Shawn Winsor fined $5,000 and forfeited $2,700 for awarding a town contract his own company.
  253. Zakrzewski, Paul Docket No. 06-0022
    The Commission approved a Disposition Agreement in which Abington Board of Assessors member Paul Zakrzewski admitted to violating section 19 of the conflict of interest law by voting to approve abatement applications filed by his real estate partner. Zakrzewski paid a $1,000 civil penalty.
  254. Zager, Jeffrey Docket No. 386
    Jeffrey Zager, administrative assistant to the Mayor of Gloucester, is fined $2,000 for violating the conflict of interest law by participating in the hiring of his sister to a municipal job, and subsequently participating in contract negotiations with the union to which his sister belonged. 
  255. Zeneski, Joseph Public Education Letter 89-3
    A state employee found to have violated G.L. c. 268A, section 19 for reviewing work submitted by an engineering firm that he had agreed to work for after leaving his state job.
  256. Zwingelstein, Louis Docket No. 546
    Sheffield Conservation Commission member Louis Zwingelstein participated in approving a determination of applicability and notice of intent for an applicant knowing his business would then work privately in connection with the applications.
