Assistant Clerk Magistrate invited to an event by spouse.
Dear Assistant Clerk Magistrate _______,
This is in response to your email to the Committee dated June 7, 2023, requesting an opinion from the Committee on whether it is appropriate for you to accompany your spouse in attending the MACDL Annual Awards Dinner on June 22, 2023. You are currently the Assistant Clerk Magistrate and have explained that the MACDL dinner is not a fund raiser, but is an awards dinner; that your spouse is not a speaker, presenter, or award recipient, and that you and your husband would be paying for your tickets to attend.
The Committee has had an opportunity to discuss your question at a recent meeting, and in considering your request, the Committee reviewed the provisions of Canon 4 which, in Section (D) in particular, encourages activities to improve the law, the legal system, or the administration of justice. In discussing the question, the Committee considered the event to be an activity that contributes to the improvement of the law, the legal system, and the administration of justice, similar to other bar association annual dinners at which awards are also given. In reviewing your query, the Committee has determined that your attendance at the event as you described does not implicate any concerns.
Please note that this Advisory Committee is authorized to render opinions with respect to the Code of Professional Responsibility for Clerks of the Courts, and this opinion is limited to the Committee’s consideration of your request as it relates to that Code.
Therefore, it is the Committee’s opinion that your participation as an attendee of the MACDL Annual Awards Dinner on June 22, 2023 is permissible under the Code.
