Trial Court Rules  Uniform Small Claims Rule 5: Amendments and discovery

Rule 5

The court may at any time allow any claim or answer to be amended as justice may require. No discovery shall be allowed except upon good cause shown. Service of witness summonses shall be in accordance with the Massachusetts Rules of Civil Procedure.

Commentary

2001 Amendment. The former generalized reference to the “civil rules of court applicable to the department in which the case is pending” is no longer necessary because of the July 1, 1996 merger of the District/Municipal Courts Rules of Civil Procedure into the Massachusetts Rules of Civil Procedure.
