Rule 20
In all cases not governed by the Mass.R.Dom.Rel.P., appointment and compensation of masters shall be governed by Mass.R.Civ.P. 53(a) and (c) and SJC Rule 1:07.
Reporter's notes
(2012) Eliminates reference to court appointed auditors, assessors or arbitrators, which no longer exist. The rule is changed to be consistent with the Probate and Family Court Department's SJC Rule 1:07 procedures which permit an attorney to be on the list for Master appointments in up to four divisions at once.
The rule is also changed to reflect the usual practice by which the parties pay a discovery master at an hourly rate that has not been approved by a judge, and the master may re-allocate the payments if one party runs up the costs.
