Executive Order  No. 366: Declaring a state of emergency resulting from unprecedented snowfall in the Commonwealth

WHEREAS, Massachusetts has received a record-breaking snowfall this winter;

WHEREAS, snow is forecasted to fall in areas of the Commonwealth during the next weeks and is likely to fall from time to time at least through April;

WHEREAS, state and local authorities have acted valiantly to remove snow from the public ways so as to allow the continued flow of emergency vehicles and other traffic necessary to the safety and prosperity of the Commonwealth and its citizens; and

WHEREAS, the unprecedented snowfall has required the use of heavy equipment not ordinarily permitted to travel on the public ways of the Commonwealth for the removal of snow;

NOW, THEREFORE, I, William F. Weld, Governor of the Commonwealth of Massachusetts, acting pursuant to the power provided by Chapter 639 of the Acts of 1950, as amended, and by virtue of the authority vested in me as the Supreme Executive Magistrate, do hereby issue this proclamation that there now exists in the Commonwealth of Massachusetts a STATE OF EMERGENCY, and order as follows:

When a snow emergency has been declared by the chief executive officer of any city, town, county or other public agency or authority, the maximum vehicle width, as provided in G.L. c. 90, §19, the maximum axle weights, as provided in G.L. c. 90 §19A, and any minimum speed limit on any way, shall not apply to any vehicle being operated on any public way in the performance of public snow-clearing duties during the snow emergency.

This Executive Order shall supersede any inconsistent laws or regulations.

This Executive Order shall remain in effect until rescinded or for 60 days, whichever is sooner.
