Executive Order  No. 203: State building code commission

WHEREAS, the State Building Code Commission, established under the provisions of section sixteen of chapter twenty-three B of the General Laws, was abolished by section two hundred seventy-two of chapter three hundred fifty-one of of the acts of 1981; and

WHEREAS, the state building code and the regulations of the abolished commission remain in full force and effect and must be complied with by builders and the construction industry; and

WHEREAS, licenses and permits relating to building and construction cannot be issued nor can appeals relative to the state code be heard; and

WHEREAS, an agency must be granted authority to administer these vital provisions of law;

NOW, THEREFORE, I, EDWARD J. KING, Governor of the Commonwealth, under the power granted to me by section two of chapter thirty of the General Laws, do hereby order as follows:

  1. The division of inspection, within the Department of Public Safety, shall have sole authority to administer the powers, duties and regulations of the abolished State Building Code Commission until such time as the General Court shall make provision for the administration of the powers thereof.
  2. This order shall take effect immediately.
