Scope

Section 2-601

In the absence of a finding of a contrary intention shown by the terms of the will, the rules of construction in this part control the construction of a will.

Comment

Purpose and scope

Common-law rules of construction yield to a finding of a contrary intention.

See § 43 of Chapter 521 of the Acts of 2008 for the application of the rules of construction in this Part to documents executed prior to the effective date of this Article.

Massachusetts comment 

Under current Massachusetts law, one can determine a testator's intention by looking only at the will itself. G.L. c. 191, § 1A(2).
