WHEREAS, Executive Order No. 42 was issued on September 15, 1961, and

WHEREAS, it has now become advisable to make certain amendments in said Executive Order,

NOW, THERFORE, I, John A. Volpe, Governor of the Commonwealth, acting under Stat. 1950, Chapter 639, as amended, and in particular sections 4, 6, 7, 8A and 20 thereof, and all other authority hereunto enabling, do hereby amend said Executive Order 42 in the following respects, as a necessary preparatory step in advance of actual disaster and as a measure of cooperation with the Government of the United States in matters pertaining to the Civil Defense of the Commonwealth and the Nation.

1) Paragraph 2 of Executive Order 42 is amended to read as follows:--

"2. All offices and positions in the division of Civil Defense, excepting the Director, are hereby made subject to the Civil Service laws and rules as of the effective date of this Order."

2) Paragraph 3 of Executive Order 42 is amended to read as follows:--

"3. All offices and positions in a local organization for civil defense established in a city under Section 13 of said Chapter 639, excepting the office or position of director of said organization, if not previously classified under the Civil Service laws and rules, are hereby made subject to the Civil Service laws and rules as of the effective date of this Order."

3) Paragraph 5 of Executive Order 42 is amended to read as follows:--

"5. Any person who on the effective date of this Order is employed in an office or position in the division of Civil Defense, or in a local organization for civil defense in a city, or who is employed in an office or position in a local organization for civil defense in a town on the date said town accepts the provisions of paragraph four of this Order, may continue to serve in such office or position until such time as an appointment to that office or position has been made from an eligible list after an open competitive or qualifying examination in accordance with Chapter 31 of the General Laws; provided, however, that such examination shall be given within sixteen months after the date said office or position becomes subject to the provisions of the Civil Service laws and rules in accordance with the provisions of this Order. Incumbents of offices and positions who under the foregoing provisions of this paragraph may attain civil service status by the passing of a qualifying examination, but who have passed the written part of the open competitive examination held by the Division of Civil Service in the current year for the same office or position, will not be required to take such qualifying examination, but shall be considered qualified as the result of the open competitive examination referred to herein."

4) Paragraph 9 of Executive Order 42 is amended to read as follows:--

"9. This Order shall be effective as of September 15, 1961."
