Executive Order  No. 69: (1st Series) Implementing federal requirements re manufacture and repair of hot water tanks

Table of Contents

WHEREAS, compliance with General Laws (Ter. Ed.) chapter 142, sections 17, 18 and 19, as amended, requires that certain materials which have become so necessary to the prosecution of the war as to be called "critical materials" be used in hot water tanks manufactured or repaired for use in the Commonwealth; and

WHEREAS, the Government of the United States acting through the War Production Board has limited or prohibited the use of such materials in the manufacture or repair of such tanks to an extent precluding compliance with the provisions of said sections; and

WHEREAS, hot water tanks manufactured or repaired in accord with War Production Board limitations cannot now lawfully be installed in certain localities of the Commonwealth; and

WHEREAS, it is essential to the protection of the health and safety of the inhabitants of this Commonwealth that hot water tanks be available to them;

NOW, THEREFORE, I, Leverett Saltonstall, Governor of the Commonwealth of Massachusetts, acting under the provisions of Acts of 1941, chapter 719, as amended by Acts of 1943, chapter 3, Acts of 1942, chapter 13, sections 2 and 3, and all other authority vested in me, do hereby issue this order as a measure necessary and expedient for meeting the supreme emergency of the existing state of war between the United States and certain foreign countries.

The Chairman of the Board of Boiler Rules is authorized and empowered, with the approval of the Board of Boiler Rules and the Commissioner of Public Safety, to suspend, relax or modify the application or operation of General Laws (Ter. Ed.) chapter 142, sections 17, 18 and 19, as amended, to such extent as he may deem said sections to be inconsistent with War Production Board Order L-199 or any amendments or additions thereto or substitutions therefor. The authority herein conferred upon the Chairman may be exercised by him by filing with the records of the board an order or orders for such suspension, relaxation or modification, signed by him and approved in writing by the Board and by the Commissioner.

Any action undertaken or completed pursuant to and in accordance with any such order of the Chairman shall not be deemed to be unlawful by reason of any provision of law, including the provisions of General Laws (Ter. Ed.) chapter 142.

GIVEN at the Executive Chamber in Boston, this nineteenth day of May, in the year of our Lord one thousand nine hundred and forty-four, and of the Independence of the United States of America, the one hundred and sixty-eighth.
