Executive Order  No. 70: (1st Series) Issuance of temporary motor vehicle licenses of armed forces personnel

WHEREAS, the licenses to operate motor vehicles on the ways of the Commonwealth of many persons in the armed forces of the United States expire while said persons are absent from the Commonwealth by reason of service in such forces; and

WHEREAS, when such persons, whose said licenses have so expired, return to the Commonwealth on furlough or leave they are required by law to procure new licenses if they desire to operate motor vehicles on the ways of the Commonwealth and to pay the prescribed annual fee therefor, notwithstanding that the period during which they will operate motor vehicles on the ways of the Commonwealth will be of short duration; and

WHEREAS, the issuance of temporary permits to operate motor vehicles on the ways of the Commonwealth, without the payment of any fee therefor, to such persons who are actually serving outside the Commonwealth with the military or naval forces of the United States, and who are temporarily on furlough or leave, will promote the effective prosecution of the war by contributing to the welfare, convenience and morale of said persons:

NOW, THEREFORE, I, Leverett Saltonstall, Governor of the Commonwealth of Massachusetts, acting under the provisions of Acts of 1942, chapter 13, section 2 (15), and section 3, and all other authority vested in me, do hereby issue this order as a measure necessary and expedient for meeting the supreme emergency of the existing state of war between the United States and certain foreign countries.

The Registrar of Motor Vehicles is authorized and empowered to issue temporary permits in such form as he may prescribe to operate motor vehicles on the ways of the Commonwealth, and without the payment of any fee therefor, for such period of time as he may deem proper, but in no event for more than thirty days, to those persons serving outside the Commonwealth in the military or naval forces of the United States, who were licensed to operate motor vehicles on the ways of the Commonwealth at the time of entering said forces, and who are temporarily within the Commonwealth on furlough or leave.

The phrase "serving in the military or naval forces of the United States," as used in this order, shall be taken to include service other than in a civilian capacity as a member of any corps or unit established under the laws of the United States for the purpose of enabling women to serve with, or as auxiliary to, the armed forces of the United States.

Every temporary permit issued pursuant to the authority conferred by this order shall be subject to all conditions, rules and regulations and provisions of law to which licenses issued under General Laws (Ter. Ed.) c. 90, are subject other than the payment of a license fee and the requirement that the applicant therefor shall pass an examination as to his qualifications.

The power and authority conferred by this order shall be in addition to, and not in derogation of, the provisions of Acts of 1941, chapter 708, section 23, as amended by Acts of 1943, chapter 421.

GIVEN at the Executive Chamber in Boston, this twenty-fourth day of May, in the year of our Lord one thousand nine hundred and forty- four, and of the Independence of the United States of America, the one hundred and sixty-eighth.
