WHEREAS, I, Leverett Saltonstall, Governor of the Commonwealth of Massachusetts, issued on the twenty-ninth day of December, 1941, with the advice and consent of the Council, a proclamation setting forth a state of emergency pursuant to the provisions of Acts of 1941, c. 719, Part II, sec. 6 (a); and,

WHEREAS, on the eighteenth day of December, 1941, I, as Governor of the Commonwealth received a communication from Franklin D. Roosevelt, President of the United States, in which the President states that it was essential to the national defense that the employment service of each of the States be transferred to and operated by the United States Employment Service as a uniformly and nationally operated employment service, and in which communication the President requested that I instruct the proper officials of this Commonwealth to transfer to the United States Employment Service all the personnel, records and facilities now employed or utilized in connection with the employment service functions of the Division of Employment Security of the Commonwealth, which may be required for the efficient operation of the proposed unified United States Employment Service; and,

WHEREAS, the Social Security Board of the United States and the United States Employment Service have prepared and issued detailed plans and instructions with respect to the manner in which the said request of the President of the United States is to be effectuated:

NOW, THEREFORE, I, Leverett Saltonstall, Governor of the Commonwealth of Massachusetts, acting under the provisions of said Acts of 1941, ch. 719, by virtue of the authority conferred upon me by the said Act and of all other authority vested in me, do hereby issue this order for the purpose of co-operating with the Federal authorities in the aforesaid matter pertaining to the common defense and for the purpose of carrying into effect the said request of the President of the United States for said action looking to the national defense:

1. The Director of the Division of Employment Security of the Commonwealth is hereby authorized and directed to deliver and entrust to the United States Employment Service for use by it for the duration of the present emergency, as defined in chapter 719 of the Acts of 1941, such records and equipment of the said Division as may be determined by the United States Employment Service to be necessary for the operation of the said Employment Service in accordance with the aforementioned request of the President of the United States.

2. The Director of the Division of Employment Security of the Commonwealth is hereby authorized and directed to furnish the United States Employment Service for the duration of the present emergency, as defined in chapter 719 of the Acts of 1941, access to such records of the said Division, other than the records referred to in paragraph 1, above, as the United States Employment Service may deem essential for the operation of the said Employment Service, in accordance with the aforementioned request of the President of the United States.

3. The Director of the Division of Employment Security of the Commonwealth is hereby authorized and directed to furnish the United States Employment Service such supplies and forms as me be required by the United States Employment Service up to March 31, 1942, for the operation of the said Employment Service in accordance with the aforementioned request of the President of the United States.

4. The Director of the Division of Employment Security of the Commonwealth is hereby authorized and directed to make available to the United States Employment Service for the duration of the present emergency, as defined in chapter 719 of the Acts of 1941, the full use of all local offices of the said Division and joint use of such parts of the central office of the said Division as the United States Employment Service may deem essential for the operation of the said Employment Service in accordance with the aforementioned request of the President of the United States. The Director is also hereby authorized and directed to furnish adequate telephone service, light, heat and power in the said local offices and portions of the central office so made available by him to the United States Employment Service.

5. The Director of the Division of Employment Security of the Commonwealth is hereby authorized and empowered to utilize, for the duration of the present emergency, as defined in chapter 719 of the Acts of 1941, such of the available services, facilities and information of the United States Employment Service and of its employees as he may deem desirable in connection with the exercise of his powers and the performance of his duties as specified and enumerated in the laws of the Commonwealth, to the extent that similar services, facilities and information now are, or heretofore have been, furnished by the officers or employees of the Division of Employment Security.

6. The Director of the Division of Employment Security of the Commonwealth is hereby authorized and directed, in addition to the matters specifically set forth in the foregoing paragraphs, to take such further action for the duration of the present emergency, as defined in chapter 719 of the Acts of 1941, as may be necessary to effect the transfer of records, equipment and facilities of the Division of Employment Security to the United States Employment Service as set forth above and to facilitate the operation of the United States Employment Service in accordance with the request of the President of the United States.
