Executive Order  No. 33: (1st Series) Authorizing appointment to Industrial Accident Board of person to replace member temporarily absent on Military Service

Table of Contents

WHEREAS, the necessities of war production have resulted in a great increase in the number of persons engaged in industry, including an increasing number of persons with little or no experience in the use of machinery or other mechanical equipment; and

WHEREAS, these conditions have resulted in a large increase in the number of industrial accidents causing injuries to workmen giving rise to claims for compensation under the Workmen's Compensation Act, so called, which claims, when disputed, are determined by members of the Industrial Accident Board; and

WHEREAS, the Industrial Accident Board, by the efficient and judicious exercise of the powers conferred upon it by General Laws (Ter. Ed.) chapter 152, section 46, is enabled to increase the number of skilled workers available for employment in war industries, as is urgently requested by the President of the United States; and

WHEREAS, one of the members of said Industrial Accident Board has recently entered upon active service in the military forces of the United States, thereby creating a temporary vacancy and decreasing the number of members available to administer and adjudicate the steadily increasing number of matters pertaining to workmen's compensation; and

WHEREAS, the Chairman of the Industrial Accident Board is unable to designate any person in the employ of the said Board to perform the duties of the absent member pursuant to Acts of 1941, chapter 708, section 7, because the employees who might otherwise be designated for that purpose are now performing duties so vital to the efficient operation of the Department of Industrial Accidents that their designation to perform the absent member's duties would seriously impede and interfere with the function of the said department; and

WHEREAS, it is of the utmost importance for the preservation of morale and for the stimulation of maximum productivity of persons engaged in war production that the Workmen's Compensation Act be administered efficiently and expeditiously; and

WHEREAS, in the absence of a designation under Acts of 1941, chapter 708, section 7, of a person employed by the Board, there is no provision in law for the performance of the duties of the member who has entered upon active military service:

NOW, THEREFORE, I, LEVERETT SALTONSTALL, Governor of the Commonwealth of Massachusetts, acting under the provisions of Acts of 1941, chapter 719, section 7, and Acts of 1942, chapter 13, sections 2 and 3, and all other authority vested in me, do hereby issue this order as a measure necessary and expedient for meeting the supreme emergency of the existing state of war between the United States and any foreign country.

The Chairman of the Industrial Accident Board is hereby authorized to designate, subject to the approval of the Governor, a person not now in the employ of said Board to perform the duties of Board Member Thomas L. Thistle, who is on active duty in the military service of the United States. The provisions of Acts of 1941, chapter 708. section 7, apart from the requirement that the designee there- under shall be employed by the said Board, shall be applicable in all respects to the designation to be made by the Chairman of the Industrial Accident Board pursuant to this order, and shall also be applicable in all respects to the person so designated by the said chairman to perform the duties of the said absent member.
