Executive Order  No. 64: (1st Series) Use of municipal employees and trucks for the transportation of scrap materials required for war effort

WHEREAS, it is essential that large quantities of certain scrap materials and junk be made immediately available for use in the production of materials necessary for the prosecution of the existing war; and

WHEREAS, the Government of the United States, acting through the Massachusetts Salvage Committee of the War Production Board, has requested that the use of trucks, trucking facilities and employees of cities and towns within the Commonwealth be made available to aid said Committee in the collection of such scrap materials and junk for such purpose; and

WHEREAS, it will greatly facilitate the collection of such scrap materials and junk if the trucks, trucking facilities and employees of such cities and towns may be employed there- for; and

WHEREAS, the officials of such cities and towns have not the authority under existing law to use such trucks, trucking facilities and employees for such purpose:

NOW, THEREFORE, I, Leverett Saltonstall, Governor of the Commonwealth of Massachusetts, acting under the provisions of Acts of 1941, chapter 719, as amended by Acts of 1943, chapter 3, Acts of 1942, chapter 13, sections 2 and 3, and all other authority vested in me, do hereby issue this order as a measure necessary and expedient for meeting the supreme emergency of the existing state of war between the United States and certain foreign countries.

Subject to the approval of the mayor or city manager and the council or board of aldermen in cities, and the board of selectmen in towns, any board, officer, department or committee of such city or town having control of trucks, trucking facilities and employees of such city or town is hereby authorized and empowered, notwithstanding any existing law, including any ordinance or by-law, to the contrary, to use such trucks, trucking facilities and employees for the collection of such scrap materials as may be salvaged for use in the production of materials necessary for the prosecution of the war, provided that any proceeds derived from such scrap or any sale thereof as may be collected by such trucks, trucking facilities and employees are used for charitable or public purposes.

Any expenditure made for the use of such trucks, trucking facilities and employees for the purpose set forth above may be charged to such appropriation as may be designated by the mayor or city manager and council or board of aldermen in cities and the selectmen in towns.

Such trucks, trucking facilities and employees while engaged in the collection of such scrap in accordance with the authority herein granted shall be deemed to be engaged in the service and employ of such city or town.

The authority conferred by this order shall be in addition to and not in derogation of the authority otherwise conferred upon any boards, officers, departments or committees under existing law, ordinance or by-law.

GIVEN at the Executive Chamber in Boston, this eighth day of November, in the year of our Lord one thousand one hundred and forty-three, and of the Independence of the United States of America, the one hundred and sixty-eighth.
